HOA's in the News

I was very disturbed to see a news story done by WOAI Trouble Shooters on HOA's in the SA area who foreclose on homes for past due HOA fees!  I was stunned that any HOA could think it was ok to take a family's home!  Espicially for less than $1,000 as was reported in this story.

 

I have NEVER been a fan of HOA's because because they don't pay my mortgage and I dislike having to get ANYONE else's approval to do ANYTHING to MY PROPERTY!

 

I am not sure where to start with my neighborhood and how to find out if this is a practice that this HOA would condone and actually do.  I want to get involved and talk to neighbors and find out what others think and expect out of their HOA. 

 

Am I the only one outraged by this?

  If you will refer to your Declaration of Covenants, Conditions and Restrictions which can be found on the Association's web page on Neighborhood Link, you will see that you have agreed that, if you do not pay your assessments, then the Association can file a law suit and foreclose on your home for what is owed.  However, the Association Board makes every effort to work with owners who are having  a hard time making the payment.  There is an initial payment plan of half on Jan 1 and the other half on Mar 1.  If this is still too much, a special payment plan can be worked out with the member and the Board for smaller payments but the owner must let the Association know there is a problem, preferably before it becomes one.  One member worked out a plan to pay $14.75 per week until the amount was paid and she did.  No one in the Association wants to foreclose on any home for any amount but the Board is required to act to collect what is owed or it will fail in its fiduciary duty and be subject to many claims by the members who do pay on time and in full.  Many notices are sent so no one should be surprised by the Board's action if no funds are received.  The Association's funds which pay all the bills are generated by assessments so if too many people don't pay, then things will have to be closed down like the pool and the tennis courts, etc.  The Association is its members and if you want to organize a committee to review the collection procedures, then contact the current Board President, Will Brown at 659-1055 to discuss details.

I am well aware of the "Declaration of Covenants and Restrictions" that we agreed to when we bought our home.  Does NOT CHANGE THE FACT THAT THE HOA CAN ACT LIKE NAZI'S!!!!!!  My husband and I continue to PAY THIS BLOOD MONEY to the HOA on time and as agreed.  I am telling you and the HOA DO NOT EVER COME ONTO my property and dictate what I do with my home unless YOU WANT TO PAY MY MORTGAGE.  "So no one should be surprised" when I escort you OFF my property and let you know what you can do with your tennis courts and pool........which by the way we still have to pay fees to use IN ADDITION to HOA fees!  Thank you and have a nice day.  Should you wish to discuss this further or wish to point out more of the obvious please feel free to call me at 210-437-2611. Those people in the HOA may not pay your mortgage, but I'm sure tried of certain people making the neighborhood look like a dump just because they feel they should be able to do anything the want. You're probably one of those people who would walk around the neighborhood with a pet and mess in people's yard and walk away like as if nothing happened. You also seem to be a very bitter person.
