All that being said, there still were grounds for some charges....resisting, obstruction, and underage  possession and drinking.  At this point, the main weight of the problem seems to be falling with the school system.  There is an agreement that all parents and athletes sign involving these situations.  It was either ignored, or is so useless that it has no real purpose.

There is little to explain as far as the actions of the police and the breath test. You can in fact refuse a breath test. If you are driving, you will have your driving privelleges suspended but if you are walking or in a house or anywhere else, there is no criminal penalty for not taking the test. he police had no choice but to do exactlly what they did. It is pretty clear that the kids did not cooperate. No one admitted to posessing the booze and proving who bought it is nearly impossible and franklly in this case, further investigation into the matter would be  a total waste of time and money. If there was an injury or worse involved it should and would be investigated further. Look a couple of kids didnt get to play in a football game(so what in the grand scheme of life), a door was damaged(by who is still open for debate), a few kids got a  dose of pepper spray(a good lesson for the future if you ask me) and some  light got shed on the problem of teens drinking.

I am certian that no one got paid off to look the other way, no kid will loose anything except a  little playing time(none of them are headed for the NFL anyway) and the school is now under scruitny to treat everyone equally. Not bad as I see it.

 

I guess I dont see any injustice on the part of the Police Dept. I guess I am thick headed so please point it out to me.

no question there was grounds for charges being filed BUT it is called discression by the police. Police are not required to file a charge everytime they see a crime committed. Think about how many times a cop sees a cig butt thrown out the window of a car, going 2 mph over the speed limit etc etc.... That by law is a crime. I really would rather they spend time arresting real criminals wouldnt you?

The problems as I see it lay with the school system and their rules or lack of enforcement thereof. Not a real suprise given the history of MHS and how they treat different groups differentlly. I do believe that folks need to put them under the microscope and get thigs on the straight and narrow. Having said that, we must be careful what we ask for. The next group of kids caught might have one of your loved ones in the group and the whole thng starts over again. A bit of "wiggele room" on the part of administrators must be allowed. We might not always agree on thier decission but some latitude must be allowed.

An apples to oranges comparison in my opinion.  2 mph over the limit or tossing a cigarette is in no way the equivalent of 20 high school kids getting loaded and then driving. 

And while I do fault the school policy, the way it is worded makes it difficult to discipline without charges being filed.  The police failed.
