I agree that they could have registered earlier, but the point of election day registration is to encourage greater participation. If someone decides to vote at the last minute it's their privilege to do so. Informed or not, they have the right to vote. God knows we've got enough lo-information voters already, I don't think a few more is going to skew the system.
As for when the fines and punishments kick in, I do not know. I'm sure they have to be charged and tried, however, I believe that all non-ID-same day registration ballots are treated as provisional until they can be verified.
