A Legendary Land of Wealth & Happiness!

If you are new to El Dorado – or even if you’re not – you may be wondering what the name El Dorado means.

Each month the SUNBURST proclaims El Dorado to be “a legendary land of wealth and happiness.” This is a lovely description. It conjures up images of gold and happiness all around. It says El Dorado is a place where wealth and happiness are free for the taking. Is that an exaggeration?

El Dorado Homes Association was incorporated September 20, 1969. The major developers of the subdivision were Shepherd & Burris and Morton/Southwest.

When the subdivision first started, it was outside the city limits. Cattle grazed in bluebonnet fields. Seven windmills operated in the confines of El Dorado, and the lake was actually a cow pond.

A local dairy made home delivery, and deer were everywhere. Perrin Beitel and Nacogdoches were two lane roads. The nearest place to buy groceries was a Piggly Wiggly at Nacogdoches at Loop 410. There were no restaurants in the area, and the tower of the Americas could be seen from the subdivision.

Sounds like a golden setting!

Today, El Dorado is definitely in the city! The bluebonnets, the deer and the windmills are gone. So is the view of the Tower of the Americas. Nacogdoches and Perrin Beitel are busy city streets complete with city noise and traffic problems. And businesses are all around us, bringing convenience and confusion.

Currently El Dorado is a microcosm of the world. We are people of many races, ages and creeds. We are military and civilian. We are business and agriculture. (How many back yard gardens can you count?) We are the children, parents and teachers of a neighborhood school. We are all those who enjoy the pool, the lake and the paseo. We are even those who damage and vandalize. We are growth and decline. We are newlyweds who will start our lives here. We are the children who are born and raised here. We are the retired who will grow old and die here.

Indeed, El Dorado is microcosm of the world. Is it an exaggeration to describe this community as a legendary land of wealth and happiness?

By no means! In the diversity of our community there is a wealth of knowledge, happiness, and experience – all free for the taking. The joy and riches of our community can be found in our people. We are many different people who are willing to learn from one another and grow into one diverse community.

We may still struggle. We are not perfect yet. But if you wonder what to call our community – Call it El Dorado, the legendary land of wealth and happiness!

 

About our association

Articles of Incorporation of El Dorado Homes Association, Inc.

We, the undersigned natural persons of the age of twenty-one (21) years or more, at least two of whom are citizens of the State of Texas, acting as incorporators of a corporation under the Texas Non﷓Profit Corporation Act, do hereby adopt the following Articles of Incorporation for such corporation:

ARTICLE ONE

The name of the corporation is EL DORADO HOMES ASSOCIATION, INC., and is hereafter called the "association".

ARTICLE TWO

The street address of the initial registered office of the corporation is 1 Bludau﷓Bishop Road, San Antonio, Bexar County, Texas, and the name of its initial registered agent at such address is CLIFFORD MORTON.

ARTICLE THREE

The association is a non﷓profit corporation. No part of the net earnings of the association shall ever inure to the benefit of any member of the corporation.

ARTICLE FOUR

El Dorado Developers is the owner of certain property in the City of San Antonio, Bexar County, Texas, which is more particularly described as:

TRACT ONE: 327.08 acres of land, more or less, consisting of three tracts or parcels of land and being the same land described in deed dated March 15, 1968, executed by Alamo and Commerce Corporation in favor of El Dorado Land Development Company, Inc., recorded in Volume 5927, page 389 of the Deed Records of Bexar County, Texas, to which record reference is here made; however, there is EXCLUDED from such land the following tracts:

(a) a tract of land containing approximately 11.00 acres, more or less, under option to the North East Independent School District;

(b) a tract of land containing approximately 4.05 acres, more or less, under option to the City Public Service Board;

(c) i. a tract of land containing approximately 6.711 acres, more or less, bordered by Camino Dorado, Nacogdoches Road, El Dorado Unit 1 and Leonhardt Road.

ii. a tract of land containing approximately 1.714 acres, more or less, bordered by Nacogdoches Road, El Dorado Unit 1, the North boundary on the 327.08 acre tract and a South boundary along a drainage channel.

iii. a tract of land containing approximately 4.728 acres, more or less, bordered by Camino Dorado, Nacogdoches Road and El Dorado Unit 1 with a North boundary along a drainage channel.

The "common area" as that term is used in these articles and for all purposes shall be the following property contained within Tract One above:

TRACT TWO: A 13.468 acre tract, the same being an artificial lake, and said tract being more particularly described in the attached Schedule A.

TRACT THREE: A 0.122 acre tract, the same being an entranceway and median, and being more particularly described in the attached Schedule B.

TRACT FOUR: A 0.037 acre tract of land, being an entranceway median, and being more particularly described in the attached Schedule C.

TRACT FIVE: A 2.524 acre tract of land, being the property on which the club house, swimming pools, tennis court, parking lot and kiddy park are located, and being more particularly described in the attached Schedule D.

TRACT SIX: All paseos presently in or to be constructed within Tract One.

The common area property, SAVE AND EXCEPT the paseos not yet constructed, shall be conveyed by El Dorado Developers to the association within thirty (30) days after the entity of El Dorado Homes Association, Inc., comes into existence. Title to all paseos shall pass to the association upon construction completion.

ARTICLE FIVE

The purposes for which the corporation is formed are to provide for maintenance and preservation of the common area, as described above, and to promote the health, safety and welfare of the residents within the above described property and any additions thereto as may hereafter be brought within the jurisdiction of this association, and for this purpose to:

(a) exercise all the powers and privileges and to perform all of the duties and obligations of the association as set forth in the By﷓Laws of the association;

(b) fix, levy, collect and enforce payment by any lawful means, all charges or assessments pursuant to the provisions of the By﷓Laws of the association; to pay all expenses in connection therewith and all office and other expenses incident to the conduct of the business of the association, including all licenses, taxes or governmental charges levied or imposed against the property of the association;

(c) acquire (by gift, purchase or otherwise), own, hold, improve, build upon, operate, maintain, convey, sell, lease, transfer, dedicate for public use or otherwise dispose of real or personal property in connection with the affairs of the association; and the association shall accept, operate and maintain all paseos now or hereafter constructed within the property described as Tract One;

(d) borrow money, mortgage, pledge, deed in trust, or hypothecate any or all of its real or personal property as security for money borrowed or debts incurred; and

(e) participate in mergers and consolidations with other non﷓profit corporations organized for the same purposes, provided that any such merger or consolidation shall have the assents of two﷓thirds (2/3rds) of each class of members.

ARTICLE SIX

MEMBERSHIP
Every person or entity who is a record owner of a fee or undivided fee interest in any lot which is within that certain real property as set forth in Article Four of these Articles of Incorporation or any lot within the jurisdiction of the association, including contract sellers, shall be entitled to become a member of the association upon signing a written application or other writing to this effect or upon paying any installment due the association. The foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. Membership shall be appurtenant to and may not be separated from ownership of any lot which is subject to assessment by the association. The association may issue certificates to its members to evidence their membership.

ARTICLE SEVEN

VOTING RIGHTS
The association shall have two classes of voting membership:

CLASS A: Class A members shall be all members other than El Dorado Developers, and such members shall be entitled to one vote for each lot owned. When more than one person holds such interest in any lot, all such persons shall be members. The vote for such lot shall be exercised as they among themselves determine, but in no event shall more than one vote be cast with respect to any lot.

CLASS B: The Class B members shall be El Dorado Developers. The Class B members shall be entitled to three (3) votes for each lot owned. The Class B membership shall cease and be converted to Class A membership on the happening of either of the following events, whichever occurs earlier:

(a) when the total votes outstanding in the Class A membership equal the total votes outstanding in the Class B membership; or

(b) on January 1, 1980.

ARTICLE EIGHT

BOARD OF DIRECTORS
The affairs of this association shall be managed by a board of five (5) directors, who need not be members of the association. The number of directors may be changed by amendment of the By﷓Laws of the association. The number of directors constituting the initial board of directors of the corporation is five (5), and the names and addresses of the persons who are to serve as the initial directors are:

At the first annual meeting the members shall elect five (5) directors. Three directors shall hold office for one (1) year and two directors shall hold office for two (2) years. Thereafter, two (2) or three (3) directors shall be elected annually for a term of two (2) years, depending on whether two or three terms expire.

ARTICLE NINE

AUTHORITY TO DEDICATE
The association shall have power to dedicate, sell or transfer all or any part of the common area to any public agency, authority or utility. No such dedication or transfer shall be effective unless an instrument has been signed by members entitled to cast two﷓thirds (2/3rds) of the entire Class A membership and two﷓thirds (2/3rds) of the entire Class B membership, if any, agreeing to such dedication, sale or transfer and the conditions of such dedication, sale or transfer, if any.

ARTICLE TEN

DISSOLUTION
The association may be dissolved with the assent given in writing and signed by not less than two﷓thirds (2/3rds) of each class of members.

Upon dissolution of the association, other than incident to a merger or consolidation of the association, the assets shall be dedicated to an appropriate public agency to be used for purposes similar to those for which this association was created. In the event that such dedication is refused acceptance, such assets shall be granted, conveyed and assigned to any non﷓profit corporation, association, trust or other organization to be devoted to such similar purposes and uses.

ARTICLE ELEVEN

DURATION
The corporation shall exist perpetually.

ARTICLE TWELVE

AMENDMENTS
Amendment of these articles shall require the assent of two﷓thirds (2/3rds) of the members of each class of members.
