Retention Pond between SCE and SIlverwood

Retention Pond between SCE and SIlverwood - This pond sits behind the duplexes on 85th E Ave and was built halfway onto SCE easement by the Silverwood developer (it was required of them in the covenants to control storm water runoff). At some point in time SIlverwood decided they no longer had to cut the half adjacent to SCE but I have read their covenants and it is clear to me that they HAD to have a mandatory HOA for maintenance of their common areas and this pond is included. We have no such clause or requirement, and thus there is not a requirement in our covenants to form an HOA to maintain the contract with the city. To me, this is a no brainier but I have not yet received info from the city planner so it is being worked.
