Restrictions for Pipkin Hills Subdivision

The undersigned, Marvin Parker Building and Development Company, being owner
of that certain property as shown on the Plan of Pipkin Hills Subdivision, of record in Plat
Book* 25/25 Page* 59/158 Registers Office of Williamson County, does hereby declare that the
following restrictions shall be covenants running with said property and binding as to all
owners thereof.
* Phases 1A & 2A

1. No lot shall be used for any purpose except for private single family residential
purposes. No structure shall be erected, placed or altered or permitted to remain on any lot
except one single dwelling designed for the occupancy of one family, not to exceed two
stories in height and containing a garage for the sole use of the owner and occupants of the
lot. No improvement, including pools and/or tennis courts otherwise authorized and
approved, may be erected upon any lot unless in conjunction with a residence located on the
same lot.

2. No building shall be located nearer to die front line or nearer to the sideline than the
building setback lines shown on the recorded plan, except bay windows and steps may
project into said areas.

3. Tile total floor area of all homes shall be a minimum of 1,200 square feet, exclusive
of the garage; but including expansion areas. There shall be a minimum of 800 square feet
total living area on the first floor of a 1 1/2 or 2 story house. Garages are optional and are to
be built according to applicable setback and regulations. Exterior of the garage must match
the exterior of residence in material and color. No carport shall be constructed on any lot.

4. All roof pitches to be a minimum of 6/12 on entire home except porches and they
shall be a minimum of 3/12. All homes to be covered with vinyl, brick, or combination of
both, or equivalent to be approved by developer.

5. Perpetual easements are reserved for each lot as shown on the recorded Flat for the
construction and maintenance of utilities and for drainage purposes. No structure shall be
erected or maintained upon said easements, except such as are constructed for public utility
purposes.

6. No duplex or multi-family dwelling shall be permitted to be constructed on the
property.

7. No lot shall be subdivided.

8. Unless canceled, altered or amended under the provisions of this paragraph, these
covenants and restrictions are to run with the land and shall be binding on all parties claiming
under them for a period of twenty-five (25) years from the date this document is recorded
after which time they shall be extended automatically for successive periods of tell (10) years,
unless an instrument has been recorded agreeing to change these restrictions and covenants in
whole or in part

These restrictions may be canceled, altered, or amended at any time if permitted by
local law ordinances and/or regulation, by a written instrument signed by the owners of a
total of 85% of the lots in phases I thru V. All lots whether final approved or preliminary
approved shall have 1 vote each for a total of 192 votes.

9. No portable, mobile or temporary structure shall be allowed on any lot except on a lot
where a permanent structure is under construction.

10. Each lot owner shall be responsible to cut grass and weeds and to maintain and
landscape his lot.

11. invalidation of any one of the covenants by proper court degree, or otherwise, shall in
no way affect any of the other provisions herein contained, it being intended in any event that
all restrictions set therein shall remain in full force and effect.

12. No exterior antennas, or clothes lines, shall be permitted except dish antennas not to
exceed twenty four (24) inches in diameter. Dish antennas must be kept in the rear yard and
screened by landscaping from the view of the adjoining lot owners.

13. Fences prohibited except for a planted fence with the approval of the developer.

14. All out buildings must be built to the rear of the residence using same materials as
house.

15. No trailer, basement, shack, garage, barn of other outbuilding erected on property in
said subdivision shall at any time be used as a residence, temporarily or permanently, nor
shall any residence of a temporary character be permitted.

16. Nothing in paragraph 9 and 15, above, shall preclude the use of model homes, trailers,
temporary buildings used during and in connection with the development of the subdivision
and construction and sale of the homes therein.

17. Nothing shall be permitted on any of the property that may be or become a nuisance
to the neighborhood, nor shall anything be done or permitted on the property that shall be or
become noxious or offensive to the neighborhood, or dangerous to health.

18. Vegetable gardens, laundry yards, incinerators, and the like must be located to
conform to general landscaping of each lot, and screened from view by hedges or other type
of shrubbery or evergreens, but this shall not be construed to permit these or any other
activities to be conducted on a commercial basis.

19. Recreational vehicles, campers, boats, and trailers must be kept in the rear yard of
each lot and must be screened by a planting screen from the view of all adjoining lot owners.

20. No horses, ponies, cows, swine or other animals, except domestic pets shall be
permitted on the property, but vicious or offensive pets shall not be permitted to run at large.
or to become a nuisance or disturbance to the neighborhood.



21. If any present or future owner of any of the above land, or their successors, heirs and
assigns, shall violate or attempt to violate any of the covenants or restrictions herein, it shall
be lawful for any other person or persons owning any other lot or any part of the property to
prosecute any proceedings, at law or in equity, against the person or persons violating or
attempting to violate such covenants or restrictions, and either prevent him or them from so
doing or to recover damages or other compensation for such violations.

22. It shall be obligatory upon all owners of lots in this subdivision to consult with
authorities of the governing body having jurisdiction before any driveways, culverts, or other
structures of grading are constructed within the limits of any dedicated roadways, and such
placements or construction shall be done in accordance with the requirements of the
governing body having jurisdiction in order that the roads or streets within the subdivision
which shall be affected by such placement or construction may not be disqualified for
acceptance in the road system of the governing body having jurisdiction.

23. The interpretation of each/any/all words of these restrictions shall be made by
development company should question of meaning occur.

This Amendment is to change item number 13 in the Restrictions for Pipkin Hills Subdivision Phase IA
and 2A recorded in Book 1869 Page 784.

Item number 13 should now read: Ally fence constructed on any lot shall be 1 42" - 48" Wooden
Picket Fence painted white or a 6' Privacy Fence, Style 'Dog-ear", as per Developers sample. In addition
any Homeowner electing to install or have installed said fence shall also plant and maintain a shrub
and/or tree every 25' on center following ruler: and shall be planted on Homeowner's side of fence. This
shrub and/or tree shall be maintained to a minimum height of 64". Picket fence must be painted while
within thirty (30) days from start of fence. Plants must be planted within forty-five (45) days.

Homeowner shall maintain and upkeep fence in a way satisfactory to Developer at all times
Developer may, at any time, change or modify any/all of these restrictions.
Homeowner must obtain written permit from Developer before constructing fence.
Homeowner must consult with City Codes Department before constructing fence and obtain
Any necessary permits and any conflict with City Codes must be brought to Developers attention
in writting before construction starts. It shall be Homeowner's responsibility to meet current city
codes.
It shall be necessary to have a drawing showing all information about fence including layout with
measurements of fence and plantings before permit will be issued. Developer may reject any
proposed layout of fence that he feels for any reason may affect his desired appearance of
Development in any way, no matter how insignificant it may appear and even though proposed
layout may meet criteria listed in Fence Restrictions. If having a fence is of importance in
decision of buying a home in Pipkin Hills, Developer will review proposed fence design
prior to contract signing and make fence permit part of contract if design is acceptable by
Developer.

In all cases, Homeowner shall have property surveyed before fence is installed by licensed
surveyor. The fence, which must be located in its entirety in the back yard, must go from one side of
house at rear comer to a point 6' of side property Line and run parallel with side property line staying 6'
off line to a point 10' off rear property line and run parallel with rear line staying 10' off at all times to a
point 6' offside property lure and run parallel with side line staying 6' off property line at all times to a
point aligning with rear of house and then tie to rear of home.

EXCEPTIONS: (I) On lots 15, 16, 17, 18, 19, 20, 21, 22, 23, 24 and 25, the fence must remain 30' off
rear property lines.
(2) On all comer lots, fence on side next to street must remain 15' off property line.

In all cases, homeowner shall install "dress side" of fence toward his "Neighbor" and away
from his own home.

If any Pence becomes undesirable in the opinion of the Developer, written notice shall be sent
giving homeowner 30 days to repair and/or bring fence up to Developers standard. In the event fence is
not brought up to standard within the time frame, fence shall be removed by Developer and billed to
Homeowner as such for any/all expenses related to fence including but not limited to reasonable attorney
Fees.
