Voluntary Dues, a win-win alternative.

1.  The people that are for the HOA, get to keep their HOA.

2.  The people that want to dissolve the HOA, get a choice (But they still have to follow the rules).

We can make this whole issue go over much more smoothly if we make the dues voluntary.  I got this idea from a friend of mine that lives in an HOA where the dues are voluntary.  I think that Northwood Hills is a good candidate for this.  We can amend the by-laws where the dues are voluntary and the rules enforced.  The rules can be enforced with the rule/covenant violator paying the attorney fees and any fines.  People are more willing to give if they feel that they are not being forced to give.  I think that this will be an excellent compromise for both sides.  Having voluntary dues is the ONLY way that I would ever agree to Northwood Hills having an HOA.

In my last sentence from the post above, I said that having voluntary dues is the only way that I would ever agree to Northwood Hills having an HOA.  I forgot to include the issue with Section C.  Section C needs and must be included in this HOA.

i would seriously like to see some hard information about this.  seriously.  by-laws.  anything you can get in writing or on the net.  a website with all the info would be great.

 excellent idea.  thank you for your help and support.  i think this is support anyway.  with all the issues this might be something to look at.

 the covenants would still have to be enforceable and the common areas would have to be maintained.

 how long has the HOA in been around?

No, this is not support.  In my opinion, the Northwood Hills Property Owners Association does not exist.  The Association did not get the 51% of the votes to remain intact.  This can be found in Article 8, Section 5, (voting).  I think that if the association was not dissolved, (which it has, in my opinion), then, and only then, the alternative of voluntary dues could be considered.  The undeveloped and unaccessible (no official entrance), scraps of land common areas can go back to the builder/developer at this time.
