How did section D get "IN"

Section D had the same ommission that Section C had so how is it that they are included in the HOA? 

Mr. Norris I am not sure your responses to my recent posts are correct. I have seen the plat and I do believe my numbers are correct. Maybe the developer also forgot to put a couple of dozen lots on the plat?  I think you are wrong, are deliberately making up numbers or you once again relied on incorrect information in your zest to have power and control over certain unwilling victims in this subdivision.

You did not answer this: How is having a HOA going to increase the value of this subdivision when you  do not have control over 40-80 or so homeowners?  They can do as they please with their homes and yards unlike the rest of us who are subject to liens, fines and who must pay dues.  Either everybody is "IN" or the HOA should be dissolved. The way it is now makes NO SENSE at all.

You also did not answer this: Are sections A,B, E,F & G paying money to take care of the so called "common area" that is land locked behind the homes in Section C?  If they are not "IN" then we should not be paying for non-member sections of this subdivision.

 Nor did you answer this: Is Section C & D covered by the insurance we are having to pay even though they are not "IN"?  If they are no "IN" they should not be covered by anything that does not include them.

The answers to these questions should have been known before railroading and forcing some of the folks out here into the HOA mess.

Section D had the same ommission that Section C had so how is it that they are included in the HOA? The plat for Northwood Hills Section D Phase II that is on file with the Chancery Clerk states "Declaration of covenants and restrictions recorded this the 20th day of July, 2001 in Warranty Deed Book 0396 PG.0335."  The document that is on file in the warranty deed book that is referenced on the plat states the covenants and restrictions and defines the NWHPOA in regards to Section D.  The Declaration of Covenants and Restrictions for Section D Phase II can be found on pages 49-58 of the document entitled "Declaration of Covenants and Restrictions" that is posted on our Web Site.

According to the records on file at http://www.desotoms.info/ there are 232 homes in our subdivision;

Section A consists of Lots 1-52.  Includes all homes in Timber Cove, all homes on Timber Lane/Timber Lane East beginning at 1968 Timber Lane and ending at Northwood Hills Drive; and all homes on Northwood Hills Drive from Walters Drive to the four way stop at Northwood Hills Drive and Timber Lane.  Also includes the home at 610 Timber Lane East (Lot 52).

Section B consists of Lots 53-70.  Includes the 18 homes on Northwood Hills Drive from Highway 51 to Walters Drive.

Section C consists of Lots 71-118.  Includes all the homes located on Timber Way South and Timber Way North.  Also includes the following homes located on Timber Lane East: 510, 522, 530, 540, 550, 560, 570, 580, 590, 600, 525, 537, 557, 565, and 573.

Section D consists of Lots 120-159.  Includes homes located at 633 and 641 Northwood Hills Drive, all the homes in Northwood Hills Cove; all the homes located on Timber Creek Drive south of Northwood Hills Drive and all homes located in Timber Creek South.

Section E consists of Lots 160-185.  Includes homes located at 660, 642, 630, 610, and 590 Northwood Hills Drive, all homes located on Timber Creek Drive North of Northwood Hills Drive and all homes located on Timber Creek Drive North.

Section F consists of Lots 186-203.  Includes remaining homes located on Northwood Hills Drive.  Includes 696, 704, 722, 736, 748, 762, 774, 786, 796, 785, 775, 763, 757, and 745.  Also includes four homes on Northwood West Drive: 1723, 1732, 1742, and 1755.

Section G consists of Lots 204-232.  Includes all the remaining homes located on Northwood West Drive and all the homes located in Northwood West Cove.
