Let's Use Our Brains Here - More Questions For The Board

If you have a subdivision with 204 lots which is what the Northwood Hills plat says we have and Section C with 44 lots and Section D with 40 lots are not included in the HOA and therefore they do not have to follow any By-Laws how in the Sam Hill is that going to increase the value of our property?

 How does the NWHHOA Board intend to get these 84 non-HOA homeowners to follow the laws the other 116 have to follow?  This  makes the purpose of the HOA totally moot.

If the lots in Section C & Section D are not included in the HOA then why does Section A, B,E, G & H have to pay for the land upkeep in their sections?

Another question:  How did it arise that the dues of the non-legal HOA homeowners are to be kept separate from the legal HOA homeowners for a refund?  Do you have another incompetent lawyer looking into this?

Did Section C object to paying since legally they don't have to? Did you receive letters of complaint from any of them?  If so, then do you really believe that they are going to keep their property up according to the by-laws if they don't even want to pay dues?  That should tell you something about how effective a HOA will be out here under the circumstances.  

How did the Board discover that you could not take the dues from Section C and are you with-holding the dues of Section D as well since they also do not have #12 on their covenants.

This is evidently going to have to be addressed by a lawsuit and there will be big legal bills for the HOA out here as well as bad publicity for our subdivision.  The handful of people who started all this mess have opened a big can of worms. It could have been simply left alone. 

I may even go ahead and bring this matter to the attention of the local news media. I really believe that will take care of this mess for once and for all.

If you have a subdivision with 204 lots which is what the Northwood Hills plat says we have and Section C with 44 lots and Section D with 40 lots are not included in the HOA and therefore they do not have to follow any By-Laws how in the Sam Hill is that going to increase the value of our property?  MR HONESTY YOUR NUMBERS ARE WRONG.....AGAIN.  THERE ARE 232 HOMES IN ALL OF THE SECTIONS IN NORTHWOOD HILLS COMBINED.  THERE ARE 47 HOMES IN SECTION C.  AS I SAID IN A PREVIOUS POST THERE IS NOT A PROBLEM WITH SECTION D SO WE REALLY NEED TO MOVE ON PAST THAT ONE.  READ THE PAPERWORK FOR SECTION D AND YOU WILL SEE IT IS ALL THERE.  WE DO NOT KNOW IF SECTION C IS IN OR NOT.  AS SOON AS WE DO WE WILL ADDRESS THIS ISSUE.  NOT DODGING THE SUBJECT, JUST WANT TO MAKE SURE WE GIVE OUT ACCURATE INFORMATION.

If the lots in Section C & Section D are not included in the HOA then why does Section A, B,E, G & H have to pay for the land upkeep in their sections?  SECTION D IS A PART OF THE NWHPOA.  WE DO NOT KNOW ABOUT SECTION C YET AS I HAVE SAID MANY TIMES.  WE HAVE TO PAY TO KEEP UP THE COMMON GROUND, REGARDLESS OF WHAT HAPPENS TO SECTION C, BECAUSE JIMMY KIMBERLIN SCREWED UP THE PAPERWORK.  SAID THAT BEFORE TOO. 

Another question:  How did it arise that the dues of the non-legal HOA homeowners are to be kept separate from the legal HOA homeowners for a refund?  Do you have another incompetent lawyer looking into this?  WHEN WE STARTING GETTING CONFLICTING INFORMATION THE BOARD MADE THE DECISION TO HOLD ALL OF SECTION C DUES RECEIVED SEPARATE TO INSURE GOOD RECORDS AND BOOKKEEPING IN CASE WE HAVE TO GIVE THEIR MONEY BACK.  WE ALL AGREE THAT IS THE FAIR THING TO DO.  I FEEL QUITE SURE THAT OUR LAWYER IS NOT INCOMPETENT AND, AGAIN, YES HE IS LOOKING INTO SECTION C AND ALL OF THE LOOPHOLES AND ISSUES.

I may even go ahead and bring this matter to the attention of the local news media. I really believe that will take care of this mess for once and for all.  THAT IS AN EXCELLENT IDEA!  THE BOARD HAS TALKED ABOUT TAKING OUT AN AD IN THE PAPER BUT WE DO NOT HAVE ENOUGH SOLID FACTUAL INFORMATION YET TO ACT.  THAT IS OBVIOUSLY NOT A CONCERN FOR YOU.  YOU MIGHT TRY CALLING ANDY WISE AT CHANNEL 3.  I BET HE CAN HELP US.  JUST TELL US BEFORE YOU DO.  I WANT TO BE SITTING DIRECTLY IN FRONT OF JIMMY KIMBERLIN WHEN THE STORY BREAKS.  EXCELLENT IDEA!  ARE YOU SURE YOU DON'T WANT TO VOLUNTEER TO HELP US.  I REALLY THINK YOU COULD HELP.  YOU'RE VERY CREATIVE.  LET ME KNOW IF YOU'RE INTERESTED.
