MCINTYRE POOL RULES FOR 2009

Safety
1. Safety is first and utmost. Absolutely NO GLASS containers or breakable objects of any kind are permitted in the pool or playground area. NO ALCOHOL is permitted and persons that are obviously under the influence of intoxicants will NOT be permitted to use the pool.
2. NO running, pushing, wrestling, diving or other horseplay is permitted in the pool. Fighting, bad language and profanity are prohibited, and violation will result in PERMANENT suspension from the pool area.
3. NO towels or foreign objects (paper, cans, etc.) in the pool. Flotation devices, masks, fins and snorkels and water guns may be allowed in the pool as long as they do not create a nuisance or inconvenience to other people in the pool area.
4. The pool will be evacuated during any emergency situation or thunder and lightning. Participants may re-enter the pool 30 minutes after the last heard thunderclap under the direction of Lifeguards.
5. When a Lifeguard is present, their instructions must be followed to insure the safety of residents and their guests. People with disruptive behavior will first be given a warning to stop, then they will be given a time-out and finally asked to leave if it continues and possibly suspended.
6. No one is allowed to climb over or through the fence in the pool area. Violators will be prosecuted.
7. The Pool has no responsibility for any valuables or personal property brought into the facility.
8. All persons using the pool, do so at their own risk. The Homeowners Association and its Management Company assume no liability for accidents, injuries or death. All residents are responsible for the safety and supervision of their own families and guests.
Children
9. All children 14 and under must be accompanied in the pool and pool area by a Resident at least 17 years old, who is directly responsible for them. All children are solely the responsibility of their parents. All Adult Residents agree to release and indemnify the Association from any claims, losses, or liability arising out of the use of the pool.
Guests
10. ONLY Residents and their guests are permitted in the pool. Residents will be held responsible for actions of their guests at all times. Residents are responsible for his/her family and guests and may be charged for damaged property. All guests must be accompanied by their inviting resident while in the pool area.
11. Each household member 15 and over must have their own pass for entry into the pool.
12. Must be a Current Resident at least 21 years old to bring in guests. Each HOUSEHOLD is allowed four (4) free guests and additional guests at a cost of $5.00 per person. Children up to three years old are free.
Health & Cleanliness
13. Caution your children to use the bathroom facilities at the pool area. NO rocks, debris, gum, spitting or blowing of nose will be allowed in the pool and pool area.
14. All persons entering the Pool must wear a bathing suit. NO STREET CLOTHES allowed in Pool, except for white t-shirts will be permitted. ABSOLUTELY no jean cut-offs, basketball shorts or thongs permitted. Swim Shorts must be worn at the waist. NO SAGGING SHORTS.
15. Children in diapers will NOT be permitted in the pool without rubber pants over the diaper. Speedo type swim suits or elastic pants are preferred.
16. Admission to the pool will be DENIED to all persons having any infectious disease. Persons with excessive sunburns, open sores, bandages, inflamed eyes, colds, nasal or ear discharge or any other ailments which could adversely affect water cleanliness, and/or endanger the well-being of others will NOT be permitted in the pool.
17. Absolutely NO PETS, skateboards, skates, or bicycles are permitted inside the pool area.
18. Showering off before entering the pool is preferred.
19. No Smoking will be permitted within the pool area.
Pool Equipment
20. Under NO circumstances is any person to play with the cleaning implements.
21. Pool furniture may NOT be removed from the pool area at any time or placed in the pool.
22. Life preserver rings and life saving devices displayed in the pool are for emergency purposes only.
23. The telephone is required by NC state law for emergency purposes ONLY. Personal calls are not permitted.
Noise
24. Due to the close proximity of some homes to the pool area, and so as NOT to interfere with other pool guests, the noise level must be kept to a normal level.



Schedule of Operation
25. The Pool hours will be as follows: 10:00 a.m. to 8:00 p.m. Monday through Saturday. Sunday 12:00 p.m. to 8:00 p.m. Adult Swim only Saturdays and Sundays from 7:00 p.m. to 8:00 p.m. Except from May 26th to June 10th, Pool hours during the week will be 4:00 p.m. to 8:00 p.m.
Parking at the Pool
26. The pool parking lot is reserved for residents who choose to drive to the pool or use the Park. Residents are not allowed to use the Parking area for any other reason. Front of Pool house is for drop-off purposes only. No Parking is allowed.
Pool Passes
27. Homeowners must be current on their Dues or on a repayment
plan with Pinnacle Management to be allowed access to Pool. No Resident will be allowed entry to the pool without their pool pass.
28. If a pool pass is lost, it must be reported to the Pool Attendant for request of a new one for a cost of $10.00. Proof of identify (2 ID’s) must again be presented before replacement is issued.
29. The Pool Committee and McIntyre Board have the authority to revoke or suspend a pool pass at any time of a violation of pool rules and only upon review from the Board will it be reissued. Upon a third suspension of a pool pass, the pass can be revoked for up to two weeks and thereafter further review to reissue.
30. Pool Management reserves the right to conduct swim tests to prove
swimming ability if they deem necessary.
31. Pool Management reserves the right to enforce the rules as defined
above and at its discretion to ensure a safe and enjoyable pool environment
For ALL residents and their guests.
32. FAILURE TO FOLLOW PROPER BEHAVIOR AT THE POOL MAY RESULT IN THE FOLLOWING:
A. First Offense = Verbal Warning
B. Second Offense = Time out from Swim
C. Third Offense = Expulsion from Pool for up to
two weeks.

33. NO FOOD ALLOWED IN POOL AREA. ONLY BOTTLED
WATER.
