  The HOA deemed my fence in need of repair.

I agree with the HOA. But the cause of the damage was by the common area collapsing toward the lake pulling my fence with it. 

If I repair the fence, and the common area continues to collapse then my new fence will be in vain since it will continue to disrepair any corrections. 

I currently removed the fence, however there is a new part that cannot be removed. I hold TL to damages and repairs to that part.
