Okay, does anyone have a good phone number for the Association?  I'd love to chat with them about my "dues".

The Board of Directors we elected June 18, 2008 don't want to communicate with the members. They don't want you to know anything about them. They hired professional management to do what we elected them to do. I might add without your permission, they never even ask for your permission. $155.00 is not a lot of money now days, but it is about twice what your assessment should be each year in River Run.

 

Board of Director term is from January 1st to December 31st each year. We have not elected any Board of Directors since June 18, 2008, thereforth, we have NO Board of Directors since December 31st, 2008. NO association can do business without Board of Directors. There MUST BE 3 of the 5 Board of Directors elected present at every meeting, before there can be any business done at a meeting.

 

I would love to chat with someone about my dues, too. The only person you can talk to is the association attorney. You don't want to talk to him, because he is getting paid to collect your dues. He don't care if you owe what you are being assessed or not. He is going to take you to Small Claims Court to collect your assessment, attorney fees, and court cost. If it looks like a SCAM, it probably is.

I understand all that. 

What I want to know about is,

When are the dues due each year?

Am I paid up and current?

Whatever happened to the system I heard a rumor about, where we were supposed to be able to make quarterly or monthly payments on the dues?

 

That kind of thing.

 

I understand that the association has been operating illegally and overcharging us all for years.  I would fully support a class action law suit against the association.  I'm going to start looking this week into how to get that ball rolling.

 

In the mean time, I want to pay what I "owe" so that I'm in compliance with my side of the agreement.  That's all.

What I am trying to point out is that a illegal assessment is not collectible. You MUST pay your yearly assessment. A approved assessment is to be paid by the end of Febuary each year. All dues must be paid before you can Vote for or be a Board of Director, ect. I know our attorney disagrees with this," You do have the right to be at meetings, you just can't vote if your dues are not up to date." Monthly payments could keep you from voting.

 

I fully support a class action suit against the association. But to win a class action suit you will need to try getting the association to operate legal first. I been trying for 5 years. I have talk to lawyers and they tell me to get more of the members of the association involved. Finally, we are having discussions. The problems this association has can not be solved in a hour and a half meeting each year. You and I can not solve the problems alone. At one time I had about 30 members willing to help get Board of Directors elected in River Run. We finally elected Board of Directors that were no better than what we had. I believe the reason is they are using the same attorney. The association attorney we have don't believe in using our Declaration to make decisions for the association.

 

I need to have a meeting with you, call 821-1933 this week. I am remodeling a house in KY. Will be going back to KY next week. Anybody else want to volunteer their services to get this association back legal, give me a call. We only have one of the five Board of Directors we elected in 2008 still on the Board.
