We are going into another year where the membership is not in control of the Association. Our 2010 Assessment has to many items in it that has not been approved by the membership. I have posted the rules on making an assessment on this list so every member would know what is required of them. Here it is one more time; Your Regular Yearly Assessments are for maintenance, repairs and ordinary operating expenses, including Common Expenses for the Common Areas, based on the previous years assessmrnt for these items. That is it, nothing else unless it has been approved with the votes of the membership. With all the (894) lots sold in River Run, your Regular Yearly Assessment for 2010 should be between $75.00 and $90.00, not $155.00 as we are assessed in 2010. With the number of lots sold in River Run, the cost for maintaining the Common Areas and Play Grounds should be low.

In 2010 the Membership needs to take control of the Association and run the Association. The membership can do this by not changing any rules but enforcing the rules we already have in the Declaration.
First, we need to NOT pay the 2010 Assessment as we have been assessed. We need a new approved assessment for 2010 to pay.
Second, we need to elect (5) Board of Directors for 2010, this must be done annually. ( We never elected any Board of Directors for 2009.)
Third, the Membership and Board of Directors must have monthly meetings in order for the members to have control of the Association. (No more Board of Director control.)
Forth, the new Board of Directors must be willing to be trained for that position. Paid for by the Association.
Filth, the Board of Directors must enforce the Articles in the Declaration and the By-Laws of the Association. (No more making up your own rules.)

NOTE: All I am asking the membership to do is enforce the rules we already have in our Declaration and By-Laws. I am giving the membership 90 days to do that, or the Association will be faced with some hefty lawsuits.

Have you got any response on this? I ask because I have a 4 month old and money is tight... if I am able to be refunded any part of the $155 I paid for 2010 HOA dues, that would be terrific. Please let me know what you find.

Hi Andrhea, I am surprised that you are the only response on this. I'm not getting anywhere with these discussions. You would think more people would be upset with being charged for something they don't owe? I see people all the time in stores and restaurants complaining about the amount they have been charged. I for one don't like paying for something I don't need or want. I been trying to stop these illegal over charges since 2006. If 2/3 of the members vote for these illegal items that we are being charged for, then I will pay them, no problem. So far this year, I have paid $84.15 of the assessment. According to their figures, I still paid more than I should. I have received a letter stating I still own the balance of the $155.00 assessment and a $25.00 late fee. I don't think I have done anything wrong by not paying for something I believe I don't owe. I also asked for more information about the $155.00 assessment. No reply of any kind, yet. The Association Members are lible for what the Board of Directors are doing. If the members don't mind paying to much assessment, then they will like paying more, when I have to pay a late fee on something I don't owe.

 

If there are any refunds, the members should vote on if there are refunds and how to handle the refunds.

How can we combat this?? I am more than willing to donate my time to go through the neighborhood to see if people actually pay attention to their HOA dues, or if they just pay it to avoid late fees, etc... Do you think that if we have a large enough petition that it would be reduced and/or any attention paid to the issue at hand? Please let me know your thoughts.

 

I especially hate the fact that so much of the 2010 budget is being dedicated to the "common areas" such as the park... however the park has been reduced down to a swing set and a horribly-kept basketball court since I moved into the neighborhood. I cannot even begin to count the times that I've called IMPD to report criminal activity that has gone on in those so called "common areas".
