Good website to read regarding many of the issues being talked about here. Based on browsing this site many HOA's do impose fines when deed restrictions are not complied with. Also can get information on how to implement the notification of non compliance.

Example of HOA procedure


This example taken from a post from the HOA website. Just one example of developing a procedure for implementing deed restrictions in BBF.

(We send out a violation letter with a photo of the violation and quote the Article and Section of the CC&R's that they have violated. We underline and put in bold type exactly what is wrong with their property. We request that they immediately correct the violation and tell them what to do. We send the letter by certified mail return receipt requested. They have either 30 or 45 days (see what your CC&R's say) to remedy the violation. If they do not, we hold a Fine Committee Meeting. The Fine Committee members has to be 3 members of the association who are not Board members nor related to any board members or any other member of the Fine Committee. The homeowner's need at least 14 days notice so we send out a Fine Committee Meeting letter also by certified mail return receipt requested. We give the 3 members a copy of all pictures and documentation related to the complaint so that they can drive by and look at the violation themselves. We also give that same packet to the homeowner. At the meeting, the Complaint Committee presents the information and then the homeowner has a chance to state their case. The Fine Committee members adjourn in private for less than 30 minutes and return with their suggestion. The Board then would accept the decision and the homeowner would be bound by the decision.
If they still do not comply, we would then seek mediation.)

Other examples here also state the HOA can recoup mediation expenses from the homeowner if they are found to be in non compliance.

The HOA here needs to set a committee to discuss the implementation and enforcement of deed restrictions.

I like you're thinking ,but Wars have been fought in less time, then what this would take. you're talking almost two months time here, with all the mailings. It has to be streamlined. I say the Trustees notify the homeowner that they are in violation, give them X amount of days to remedy, followed by one more letter and then as a last resort, fine them. If they want to dispute it, they can request a hearing in front of the Board to state their case..It doesn't have to be a large fine,but it would be enough to send a message.If the fine is not paid, it would be increased accordingly and finally sent to a collection agency.

I agree. As suggested in this example it is one of many and probably more complicated than it should be.

Please go to this site and read some of the other issues. Not much different than here. However it seems many HOA's have taken on the problem and have a process in place.

I would also like to suggest when and if a committee is established we set up meetings with other HOA's in the Powell, Dublin area. The best process would be to get to a common agreement on expectations and procedure.

We are talking about protecting investment here. I am sure that the majority of the home owners in this area are here for a reason. Rationale that I can let my home look like hell and so what for everybody else is probably not in the minds of the average homeowner.

Yes there are and will be circumstances that a committee will have to consider. It won't be one where I don't care, or I will let my neighbor do it because I am a parasite to my community.

It will take time, and people who do care to move anything like this forward. I encourage you to talk to your neighbors and ask them to talk to their neighbors about this. I am not sure when the next HOA meeting is, but I believe that if enough people are interested we can find a way to get this done.
