Park Timbers Notice to Homeowners Regarding Covenants

Park Timbers is a Covenant Protected Community

Dear Homeowner:

Welcome to Park Timbers! As a property owner in our subdivision, you are a member of the Park Timbers Homeowners’ Association. This legally recognized organization exists to protect your rights to live in a comfortable, well-maintained neighborhood. We hope that you will actively participate in our Association.

A copy of the By-Laws of the Association and the Covenants which establish restrictions applicable to the subdivision is attached. These documents detail the organization, purposes and financing of the Association. The Restrictive Covenants are the legal basis that stipulate the responsibilities and duties which are incumbent on all Park Timbers property owners. The By-Laws establish the mechanics whereby the Covenants are enforced. We urge you to read and become thoroughly familiar with these documents

The purpose of the Association is to preserve our subdivision as a high quality residential neighborhood. Accordingly, the Covenants specify the restrictions that apply to all property owners. Please refer to Article 18 for detailed information about preventing violations and the enforcement of the Restrictive Covenants in a court of law.

The Park Timbers Architectural Control Committee was established to ensure architectural integrity with existing homes. This includes design, materials and workmanship. Before any building or improvements are placed on any lot, written approval of the Committee must be obtained. Refer to the Park Timbers Directory for the current Architectural Control Committee Chairman or contact the President of the Association.

There are several sections of the Covenants that are violated periodically. In order to make the residents more aware of these restrictions, we have briefly listed them in this cover letter.

1. LAND USE – The Covenants stipulate that “each lot shall be used for single family residential purposes only.” Uses specifically excluded are rental to boarders, hotel use and professional or commercial use of any nature.

2. NUISANCES – “No noxious or offensive activity shall be carried on upon any lot.” In order to maintain the attractiveness of the area, “no house trailers, boats, trucks or similar vehicles shall be stored or maintained in any front yard or side yard or the street adjacent thereto.” The mailman has requested that the homeowners not park their vehicles in front of the mailboxes as it impedes mail delivery. Also in connection with the violations, the Association adopted a policy that basketball goals cannot be positioned within twenty (20) feet of the front lot line or nearer than ten (10) feet to any side street line. They must be constructed within the confines of the property or they will be recognized as architecturally incompatible and as constituting a nuisance to the neighbors and drivers.

3. SIGNS – No owner shall be allowed to place any signs on a lot except to advertise the property for sale, and/or for rent. This specifically bans political signs and limits contract worker advertising, i.e., roofers, painters, etc. to the time the work is being performed. In the past, signs have often been left long after the work has been completed.

4. TRAFFIC REGULATIONS – The Association strongly supports the traffic laws in this area. The speed limit is 25 mph and signs are posted within the subdivision. The police department frequently has radar patrols in Park Timbers to ensure strict adherence to the speed limit.

5. YARD MAINTENANCE – Lawn mowing and edging, etc. is required in order to meet the long established standard of maintaining a well-groomed appearance in the neighborhood.

The Park Timbers Homeowners’ Association meets at least once a year, in December, to elect the members of the Executive Committee and “determine the wishes of the majority of the Association in regard to the expenditures of the funds.” The Executive Committee manages the business of the Association and the Park timbers Homeowners’ maintenance fund. As specified in the Covenants, Article 16, Sec. L, the purchase of property in Park Timbers “shall constitute your unconditional promise to pay the annual maintenance charge.” The Homeowners’ Association meets annually to ratify the budget submitted by the Executive Committee. The Association has the authority to adjust the amount of the dues to meet budgetary needs. The charge shall not exceed $120.00 per year.

Park Timbers is divided into four (4) sections. A map denoting the street location of the areas is attached in the Covenant booklet. The Executive Committee is comprised of representatives from each section. The term of office for committee members is two (2) years. If you are interested in serving on the board or assisting in any way, please contact the President so your name can be submitted to the nominating committee. Elections are held during the annual meeting in December.

In the Park Timbers Directory you will find a list of “problem solving telephone numbers.” If you have a problem which you think should be handled by a public agency, please consult this list and contact the appropriate department. If you do not receive a suitable solution, please feel free to telephone the Park Timbers chairman who handles this committee and discuss the situation. The officers and committee chairmen are listed, with telephone numbers, in the front of the Park Timbers Directory.
