I just received a call telling me that Judge Conners dismissed BIA Law Suit against Pickerington. Can anyone reliable confirm this?

At 12:00 the radio station 610 reported something about the BIA losing. Will listen at 1:00 to see if they repeat the info and possibly find out more about the situation.

Business First

I understand in speaking with Business First that 3 of the 8 claims the BIA had against the City of Pickerington were dismissed. The BIA immediately file a motion for reconsideration that was granted.

So I believe that 5 of the 8 claims are still pending & not sure what the status or timeline will be of the ones being reconsidered.

It should hit tonights news somewhere.

Business First did say they sent a reporter to the courtroom.

Yes I think they did lose one

The Columbus Dispatch is reporting this morning that Judge Conner ruled in Pickerington's favor on the two major issues and they were the consitutional claims of the two lots per acre and the 100 homes per year housing moratorium.

They say the Builders have appealed and they have asked Judge Conner to reconsider his decision on June 7th. They doubt the Judge will reverse himself.

The Judge is scheduled to hear the builders claim of damages in September. I think the judge made it very difficult to consider damages if Pickerington acted legally in restricting the number of building permits. If the city must pay these builders damages does the city then take title to their properties?

This appears to be a huge decision for home rule communities. I think what was published in the Dispatch yesterday in regard to the Hayden Run Road development and the court's decision Wednesday for Pickerington gives new power to all of the suburban communities here in Central Ohio.

It is time for these communities to now take a stand to defend their communities from the abuses of these builders and their tactics of uncontrolled building.
