Getting a Resale Certificate

INFORMATION FOR MEMBER CONTEMPLATING
SALE OF YOUR HOME
When you sell your property, you are required to disclose certain information about it to the prospective buyer according to State Statute. Please consult a real estate attorney for details. While you may not be obligated to provide more information than the statute requires, you may choose to give added information to the prospective buyer about the Association. If you are asked to provide a Resale Certificate to a buyer who requests information about the Association, these are the procedures to follow:

You must request the Resale Certificate in writing from the Association,
specifying to whom and where you want the information sent. The Association will prepare a Resale Certificate which complies with the
Texas Property Code and deliver it to the you, your agent, your Title Company or its agent, as you request, within ten (10) days after receipt of
your request. The Associations form is the only form that the Association will complete.

Be aware that there will be a charge to you of approximately $25-$100 for preparation of the Certificate and for providing the required copies of documents, which must be paid for on or before receipt of the documents and the Certificate. Preparing this certificate is not part of the expenses of the Association paid for in the annual assessment but is a special service
fee.

After providing these documents to the buyer, if he or she agrees to purchase your home, you should suggest that the buyer contact the
Association and you should also notify the Association of the buyer??fs name and projected closing date.

Because the Association is required to state any known violations of the governing documents, please be sure that you are not in violation of any of these documents. If you have received a letter from the Association about
fence repairs, yard care, etc. which you have not corrected, this information will be placed on the Certificate. Review your records to be sure that all additions to the exterior of your property have been given Architectural Committee approval and that the Association has copies of these approvals in its files. Not having approval on improvements added to your property constitutes a violation of the Declaration. Contact the association's manager at 524-4000 if you have further questions.
