HOME OWNER''S RIGHTS

Posted in: Bayview Manor II
I have been reading this message board for some time now and have decided to respond to some of the postings.

First to all that read this board, read your deed restrictions. Anything that you are not sure of CONSULT an Attorney or NEW CASTLE COUNTY. They will not lie to you are mislead you so that they will have things their way.

As for the HOA, they have taken the word president and construed it with ruler. I don?’t mean to be harsh about it. But it is what it is.

To prove a point, At one of the meetings a HOA member stood up and asked how dare we (homeowners) talk to your president that way. As if that person were addressing the real president of the US. And even still he is human just like we are.

Next you CAN petition to change the DEED restriction it says so in ARTICLE III section I all you need is 2/3?’s of the community to agree.

If the HOA is unhappy about that then maybe we need to get together and vote to change the current committee as it stands. We do not need a dictatorship or ruler.

Last but not least, how about sending real violations. Like a neighbor who allows their dog to use the front yard as a ilet should get repeated violations. It is not sanitary for them to do so and then clean it once a week like it is a litter box.

These are the real issues that need to be addressed. To often the wrong people elect them selves for a job they cannot handle and they step down when the everything is a complete mess.

Canges need to be made for the better and with a positive outlook.

To the HOA have you thought about running the community just as Bayview I does ? Ask them how they continue to live in peace without the dictatorship of a president ?

Being the president or head of ARC does not give you the right or permission to tell people how you want them to live. It really gives you no right at all.

The HOA president is no different than being a block captain. It just includes more than one block in this case.

I am not hear to bash the job of the HOA just to let the homeowners know we do have rights and if we are not happy that we can exercise our rights.

Has anyone posed the questions how are initial home owners fees were spent ? These figures were not listed in your budget for 2006 . It just proposed how our current dues would be budgeted.

Re: Home Owner's Rights

Hello Incognito53 and all Homeowners,

I am responding to this message because it seems some of the very same issues I have are stated here.

First of all, I cannot speak for any other past Board members, but I did ?“resign?” from the Board recently not because it was too much for me to handle, but for the simple fact that I had rather remove myself than let them have the pleasure of removing me. Apparently, I had too many opinions that did not want to be heard.

Regarding your question on how Bayview Manor (I) survives, they have a maintenance company (3rd party) take care of their duties - all of them I would assume. I have often wondered why we don't just do that because it appears the current Board either does not have the time to do everything involved to keep this community up, or they do not want to make changes to keep this community up. Either way, it obviously isn't happening and MANY homeowners are complaining. Just look at our open spaces! They need to not only be cut but why can't they be lush and green like the front? It's almost May and they haven't even been maintained once this season so why would the homeowners in our community worry about their very own lawn if the open spaces aren't maintained?? Set an example for our community to follow!

I recently served on the Board, and have since ?“resigned?” because I felt my voice was unheard and unwanted. I want our community to be the BEST it can be and it appears there are small handful on the Board that want to control what is and is not done in here. I do not think the board wants to take the time to make revisions to the current deed restrictions... as I offered many suggestions and offered to keep a list of ideas to propose at the community meeting, but they were ''not interested at that time'' or ''it's a long process and too expensive'' not to mention the homeowners who voiced their opinions at the last community meeting in October 2006. First of all, how does the Board know how many changes would need to be made if they didn't announce to the community of the potential changes for the 2/3's vote? Maybe only a small portion of the community is interested in the same changes, but how will we ever know if it is never asked???

Did any of you know a Board member resigned? Isn't the Board to announce an open Board seat to the community? Has it been filled? By whom? Announced? Nothing!

And, it is ironic that you used the phrase ''dictatorship'', because I used that exact word. I was also told I had been removed from the ARC. I am assuming it was taken personally by someone on the Board or ARC because if you drive by my house, it is nicely maintained and that's all I would ever expect from the homeowners in this community - unlike the dead Christmas tree under our very own ARC Chairperson's deck stairs... ''do as I say, not as I do'' applies here.

Unfortunately, you all lost me as our Activities Committee Chairperson because I wanted to cut all ties with the current Board.

I look forward to the COMMUNITY MEETING upcoming on MAY 17th (which hasn't even been officially announced by our Board and it is in 3 weeks) and I hope that MANY homeowners attend!

I also hope that if so many of you are unhappy with the way the HOA is being taken care of, to submit your interests to the Board and RUN FOR A BOARD SEAT AT THE NEXT ELECTION!

Sadly, I do not think very many homeowners read information from this site nor do they really know about this site. It isn?’t updated frequently, obviously since I am still listed as a Board Member and the Activities Committee Chairperson when I resigned at the beginning of March. So, if you?’re passionate about change within our community, talk to your neighbors, get involved, and run for a Board Seat!
