ROW - Right of Way. On average the first 8 to 11 feet along the front of our properties and the street.
Just yesterday after the storm I had a lady call me from E. Woodlawn. She had no power and a large limb came off her tree blocking the sidewalk. She could not move it. She called 311 and the lady told her "it is your problem."
That was not true. She remembered me telling this at a meeting prior that the city would remove trees and limbs if the tree is in the ROW. That is why she called 311. I sent a message to the City Arborist and he called her on her cell phone last night, and followed up with an e-mail to both of us this am that it would be taken care of as they go through the list of damaged trees.
We will clear the sidewalk. It may take a day or two. We have had a lot of calls Donald McSween Charlotte City Arborist
Also if there is a dead tree that threatens the ROW or street and is in an unhealthy condition the city will either take it down depending on how close to the street, or if it is outside of the ROW and endangers the street ROW or that ROW edge of the property bordering the street they will tell the owner they must take it down. That would be a dead or diseased tree. The reason if the tree falls in the street it could land on a car or kill or injure someone on foot. We have had a handful of trees have to come down because of this type situation It is always nice when it can be done by the city and not cost the resident out of pocket. Duke energy has done the same for me on a few locations where people have complained about dead trees endangering their property and power lines behind homes.
Tree work can be very expensive. I know the lady I mentioned above told me she spent 1500 on one of her trees. I have spent around 5000 trimming branches and taking down 1 tree over the years at my house. It is expensive. $200 sounds like a great deal, but not sure if we would have many that would be willing to cough up the money or not. You might start another post on here when you get more details and see what the discussion / interest is on the topic.
I plan to only retire as president at the end of this year. I will still be around for at least 2 more years as a director. I just don't want the full responsibility and the time consuming position of president any longer. I have been president for 8 years of the 12 years I have been on our board.

Wow, what a long-winded fellow is our beloved Marty. One more thing, my man - the lady in the news story about you and your Curb Taliban does NOT live in Montclaire. She is on Chedworth, which is the last street, going south, in Madison Park. She had every right to gripe, and I would have griped to if I'd ever been ticketed after being "nabbed" by people who need to get a real life rather than acting like a secret cult, going behind neighbors' backs rather than talking to them, etc. And I'm so sure you're hearing nothing but good things about your efforts to turn in your neighbors. I guess that's why you're losing board members over this issue. No doubt, other Taliban members are thrilled by all the fines their neighbors had to pay -- had to pay, mind you, simply because Talibanners like yourself didn't have the nerve to do the right thing and bring up the problem with those who live around them -- you know, like REAL neighbors, not like schoolyard snitches. How can grownups be so small minded and petty? I want to leave this issue behind, so I will finish by mentioning two things: it is generally accepted that YOU are the one tallying up curb violations and handing them to the city. You've been seen tooling around in your, um, attractive vehicle, stopping to make notes, etc. We're not fools, and we're not your employees nor your kids, so you need to wake up and quit acting like some little tinhorn Hitler. One day maybe you'll finally understand that, to put it mildly, you have overstepped your bounds. Too bad everyone sees it but you. |

Thanks for your comments. I will make this one quick. I have said we checked the area in the beginning 5 months ago. That is how I knew how bad it was back in Feb. I have not driven the area in months boundary wide. Yes I do drive trhe streets amost every day going and coming just like everyone else.
Chedworth Drive has some paid members in our HOA, but that street is all Montclaire except for the 1st house corner of Londonderry Road with their drive on Londonderry. The rest of that street is Montclaire. That is why we don't have any street name toppers past Fairbanks on Seacroft and Valleyforge on Wedgewood on this South side except Londondery where we go down just past Kentland. I didn't know where the person lived until you just told me, but if she is on Chedworth then she is not in our boundary.
As for anyone getting tickets I think it was reported in May at the time of the news story that only 20 tickets had been issued in all code enforcement sweeps out of 500 plus cases at the time of the article. Codes simply does not issue tickets on the first call. They always try and educate on all calls. If someone received a ticket for a $ fine it was because they didn't listen to the warnings by the inspectors. That is why they did their sweeps. The first sweep they did was a knock and educate. Again 3 months ago. If people don't listen to the inspectors I am not sure why you would think they would listen to the HOA or me. I nor anyone else as to my knowledge in this HOA or even neighbors took part in any of the 4 sweeps conducted by codes. I don't lknow if they did more or not. Reason at the April meeting they said they would ocntinue their efforts.
So believe what you like, but you are simply wrong. There is really very little out of compliance with codes now anywhere in our community that I am aware. I asked the city to address the problem because it was out of hand. I take all the credit for doing that. The rest I don't.
That said God Bless You My Friend or X Friend since I don't know who you are. I am sorry you have gotten yourself so worked up over this issue. This is all old news from months ago. It actually was old at the time the story ran in May 2013. I hope you can move past it. |
