FL Law: "Affidavit for Breach of Peace"

FOR YOUR INFORMATION

The next time you need to call the sheriff's dept. about the noise issue, tell them you want them to come directly to your home, that you want to file an  "Affidavit for Breach of Peace".  You will need to make this phone call at the same time the noise is happening.  The sheriff's officer will provide the form.  Each resident that has a problem with the noise needs to call and request the officer come out so that they can file an "Affidavit for Breach of Peace".   You may need to "be pushy" about the issue.
After some time this residence will become a "problem location" and further events can follow through within County Government.

MISCELLANEOUS CRIMES

877.03  Breach of the peace; disorderly conduct.--Whoever commits such acts as are of a nature to corrupt the public morals, or outrage the sense of public decency, or affect the peace and quiet of persons who may witness them, or engages in brawling or fighting, or engages in such conduct as to constitute a breach of the peace or disorderly conduct, shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
