2003 UNPAID HOMEOWNER FEES

The homeowners listed below have chosen not to pay their 2003 annual fee. Numerous requests have been made to collect from these homeowners. These requests have cost the Association money and the trustees valuable time to process. As repeatedly advised to everyone, the homeowners present at the April, 2004 annual meeting voted to place liens for unpaid fees. Many homeowners have paid faithfully every year--even before 2003 & 2004. It is those paid homeowners that have been footing the bill to maintain the entrances, access lot and detention area and pay for the other expenses incurred by the Association. These costs are the responsibility of ALL HOMEOWNERS OF HAMILTON HIGHLANDS as outlined in your deed.

As of August 30, 2004, the homeowners of the below listed addresses have not paid their 2003 fee. As soon as the court papers are drawn-up and filed at the Courthouse, these lots will have property liens placed on them.

When the liens are placed, the total amount will include: 2003 annual fee, 2004 annual fee, 12% interest, filing fee of $28, ALL costs incurred to obtain the monies, $28 if unpaid and have to refile again, $32 to remove the lien. Fees could be higher if the filing fees increase. The total of all monies due MUST be paid in full before the lien can be removed (required by the court).

As you can see, this is also costing the Association quite a sum of money because the Association has to pay the filing fees up-front. Needless to say, much money will be lost which could have been used to re-do the landscaping at the entrances or build a shelter house in the detention area for all homeowners to use.

 

Final Notice Letter sent to unpaid homeowners December 3,2003

Dear Hamilton Highlands Homeowner:


The Hamilton Highlands Homeowners' Association is the HEART of our neighborhood. Every homeowner is a member of the Association. The Trustees have tried every route to obtain the fees necessary for maintaining our neighborhood. Little more than half have paid their $30.00 annual fee for the year 2003. The first of the year, our 2004 annual fee will be due.
Everyone in the community would like for our entrances to look like they were when our neighborhood was new. Over the years, they have deteriorated due to lack of funds to maintain and replace dead flowers, shrubs and landscape plants. Those homeowners who have paid our minimal $30.00 annual fee are becoming frustrated that everyone is not contributing to our community and equally sharing the cost of maintaining the entrances, access lot and retention area.
In 2003, it was voted-on to wipe the slate clean from the past regarding the dues payments. This was based on poor or incomplete records of payments made up to that point in time. Hopefully, that would be an incentive for everyone to pay. That has not happened! The annual fee is not an option for a homeowner to pay. Our $30.00 yearly payment translates to .08 cents per day or $2.50 per month.
The Association has the right to enforce payment. Again, payment is not an option. Our options include legal proceedings that could cost the homeowner more than the $30.00 dues payment. A lien can and will be placed on a property that has not paid the required annual fee. A property lien will prohibit you from selling your home or applying for a second mortgage. To remove the lien, you would be required to pay court costs, interest and the $30.00 annual dues payment. Again, we would prefer not to be forced to go that route, but can and will if necessary.
The Trustees have invested endless volunteer hours trying to maintain communication with all homeowners through newsletters, flyers, meetings and our website; yet we still get little or no response! There were friendly reminders given in the newsletters/flyers regarding the 2003 annual fee which was past-due. All homeowners were sent an invoice for the 2003 fees in January which were due the end of February. The only homeowners who would not have received an invoice at that time would be those people who purchased property after that time.
This is the FINAL notice for the 2003 annual dues payment. This letter is only being sent to those who have not paid their dues. Our records are current as to the mailing date of this letter.
If you are a new homeowner in Hamilton Highlands, the seller may have not advised you of the annual fee. This does not exempt any property owner from paying the annual fee. We do, however, understand why you have not yet paid the 2003 fee. If you have any questions, please contact the Trustees.

Please remit payment no later than 12/31/03 to avoid potential legal action.
