What Does the HOA Do?

Welcome to the HOA website!  I'd like to take a moment to explain what the HOA can and cannot do.

The HOA is responsible for being a voice for the homeowner to the Clearwater Falls LLC, addressing abatement issues, setting the budget and its priorities, setting/collecting dues, execution of maintenance agreements and other administrative functions.

The HOA is not, however, capable of enforcing covenants.  There are only two legal entities that can do this:  Clearwater Falls LLC, and the lot owner.   The HOA has no legal authority for this.

What is the Clearwater Falls LLC?  It is a group of investors that fund the development of our neighborhood.  Boyer/Young is a large investor in Clearwater Falls LLC and thus Mark Boyer and Tim Young effectively make the decisions for Clearwater Falls LLC (LLC stands for Limited Liability Corporation).

The HOA Board of Directors currently has five members, two are homeowners (myself, Ron Clough and Eric Wilson) and three employees of Boyer/Yound Development (Mark Boyer, Tim Young and Kristina Young).

Does Clearwater Falls HOA has an anual audit performed and are these audits conducted by a licensed CPA who is insured?  Also,  does this HOA provide members with complete budget records including budgeting reserves upon request?
