We do and have had Covenants

We have had some questions about the blue sheet that you should have received a few weeks ago in your latest subdivision water bill. The blue sheet listed Douglas County recorded Cottonwood covenants some residents have voiced surprise that they even exist. They do!

Summary of Cottonwood Covenants

Most, if not all Cottonwood homeowners are interested in maintaining their property's value. Most of the residents, be they owners or renters, appreciate a certain quality of life within the boundaries of their homes, neighborhood and community. All cities and most towns have ordinances to assist in these pursuits. Many neighborhoods have protective covenants attached to all property within that neighborhood. Our Town of Parker has such an ordinance called the "Town of Parker Nuisance and Nuisance Abatement Ordinance." The Cottonwood Subdivision has "Covenants" attached to the property of all residents.

PART 1: Our Town of Parker's Nuisance and Nuisance Abatement Ordinance(Excerpts)

Article II. Specified Nuisances
"...All places used... for the disassembling of automobiles, (etc.) ...or for the storing of leaving of worn out...automobiles (etc.), when such places...interfere with the comfortable enjoyment of life or property by others."

"...All places at which...occupant keeps, stores...any building materials...paper,trash...in such a manner...that the stored materials may be blown...upon any other public or private property."

"...Any animal...enclosure...which is maintained in an unsanitary condition, allowing an offensive odor to escape..."

"...unlawful... to allow any building or premises... to become offensive in odor, offensive to sight..."

"...occupants...shall prevent property...from becoming overgrown in weeds. Weeds...include brush...grasses...other vegetation grown in...unsightly fashion..."

"...unlawful...to injure, damage or destroy any tree...or other vegetation in or upon...public property..."

"...unlawful...to allow any building or premises...to be illuminated in such a manner that is offensive, interferes with the comfortable enjoyment of life or property..."

"...Every other act...on any public or private property...which is detrimental to health, offensive to sight, smell or hearing, or causes damage or injury...shall be deemed a nuisance."

"...buildings or structures shall be of new construction...No garage, carport of porch shall be constructed except as an integral part of the residence..."

"...Exterior portions of all buildings shall have manufactured finished surface materials, natural stone, brick or shall be painted of stained upon completion...all exopsed surfaces shall have a finished appearance."

"...No wehicle, whether operational or not, shall remain parked on the street...for more than fourteen days. Vehicles to be stored for indefinite periods of time shall be concealed within an enclosed garage or in the rear of the residence which is concealed form view...a vehicle is defined as an automobile, truck, trailer, camper, boat, motorcycle..."

"...the Owner of...dwelling...shall, within two years...cause all of...lot to the edge of the street surface to be suitably landscaped and maintained...shall be the duty of each Owner to keep such landscaping neat in appearance..."

"...Under no circumstances shall the drainage characteristics of any lot be altered by...construction...or erosion that is the direct result of lack of landscaping..."

"...no trailer or motor home...shall at any time be used as a residence, temporarily or permanently..."

"...On corner lots, no planting of shrubs, trees, or flowers or the erection of any fence or structure over 36 inches above the roadways shall be...permitted...within the triangular area formed by the street property lines and a line connecting them at points 30 feet from the intersection of the street lines..."

"...Nothing shall be done or permitted on the Property which may be of or become an annoyance...No noxious or offensive activities...No lot shall be used...for the storage of any...thing that will be obnoxious odors or cause any noise that will or might disturb the peace, quiet, comfort...of the occupants of surrounding property."
