The Judge's Ruling (1st part)

Travis County District Judge Jeanne Meurer granted Bill Gammon's Motion for a Temporary Injunction against the Circle C Homeowner's Association today. In a letter to Mr. Gammon and to the Homeowners Association attorneys at Gray & Becker, the judge also set out her determination of ten specific points that were raised by Mr. Gammon along with his Motion. By granting the Motion, the Judge has prohibited the Circle C Homeowners Association from conducting the election for the board of directors and from interfering with Mr. Gammon's attempts to inspect and copy the association's books and records, including the e-mail list and all other records maintained on computers or elsewhere. The Judge has asked Mr. Gammon and the association's attorneys to get together to draft an agreed-upon order which reflects her ruling and to submit it to her for her signature. The association is threatening to appeal.

Travis County Judge Jeanne Meurer granted a temporary injunction against the Circle C Homeowners Association.

Last month, attorney Bill Gammon, a Circle C Ranch resident, filed a lawsuit against the association, claiming its board members were about to hold an illegal election to fill a board seat and that it went against the association's own bylaws.

The judge sided with Gammon Friday.

Meurer prohibited the Circle C Homeowners Association from holding the election for the board of directors and from interfering with Gammon's attempts to inspect and copy the association's books and records.
