As many of you have observed and have commented on, the house on Mikris Drive North with the terrible lawn (or quite frankly, the absence of one) is being taken care of.
Just to illustrate the length of time it takes the association to get these kind of issues resolved, here is the timeline of actions that have occurred on this property:
Starting in August of 2002 the association began notifying the owner of lawn problems. It took the 95 days until the association reached the 4th letter stage, however, the growing season had come to a close so the association gave the owner until the Spring of 2003 to have the lawn problem corrected.
In April of 2003 the owner still took no action, so the association started implementing fines. It took approximately 100 days to reach the maximum fine.
At that point the association sent the package to its attorney for action. He wrote the owner and demanded action, he also filed a lien against the property for collection of the costs.
When the owner ignored his demands, he filed suit on behalf of the association. A favorable judgment order was obtained by the courts and they demanded the owner correct the problem within 90-days. However, the owner ignored the court order and is in default on that judgment.
The association has now requested the court allow the association to obtain bids and enter the property to make the required repairs as allowed for in the Covenants, Conditions and Restrictions.
In addition, the association has also sent the owner notification that it intends to foreclose the property to recover the nearly $2,670.80 in up-front legal fees, filing costs and assessments against the property.
As of the date of this newsletter, the owner has ignored these actions.
This Board wanted each of you to know that while it may appear nothing is happening, you can be assured action is being taken. We take great strides to ensure that each and every step to equal and fair enforcement is taken so that the association?’s position is not compromised.
This may appear to take too long, however, these steps must be followed correctly no matter how long it takes.
