General Rules




EAST RANCH GENERAL RULES
October, 1999

PURPOSE: These rules have been developed with the objective of assuring each owner, lessee, and their guests, the use and enjoyment of common areas and facilities in compliance with the Codes, Covenants, and Restrictions (CC& Rs) of Campus Commons East Ranch (East Ranch).


I. CLUBHOUSE USE

A. By arrangement with the Association, members may reserve the Clubhouse lounge and kitchen, rent free, on an exclusive basis, for meetings, parties or group activities as long as such use is restricted to non-commercial, social activity. The pool, sauna, jacuzzl, restrooms and other common areas must remain open to East Ranch residents and "guests" during such use.

B. Arranged for activities will require a signed Clubhouse Use Agreement. Such Agreement provides for a $100.00 refundable deposit subject to conditions outlined in the agreement which require clean up of the facility after use.
II. HOURS

A. Pool: 6:00 a.m. to 11:00 p.m.

B. Tennis Courts: daylight to dark

C. Clubhouse: 6:00 a.m. to 11:00 p.m. or by arrangement.

D. Sauna: 6:00 a.m. to 11:00 p.m.


III. POOL

A. Beverages permitted in cans, paper, or plastic containers (no glass).

B. Food limited to sandwiches, snacks and individual meals.

C. No pets in the pool area.

D. Attire while swimming shall be swimming attire (no cut-off jeans, Bermuda shorts, diapers, etc).

E. Children under fourteen (14) years of age must be accompanied by an adult.

F. All pool users are to act courteously with no running, pushing, shoving, horseplay, shouting, yelling, or unsupervised games such as "Marco Polo. "

G. No inner tubes, air mattresses or floating lounge chairs will be permitted.

H. Pool guests are limited to ten (10) guests per residence at one time.

I. No diving at the shallow end of the pool.

J After using the Jacuzzi, replace the cover neatly, with the bubble side down, ready for the next user.

K Be Considerate. For example, because the pool has entering steps on the side nearest the Clubhouse, the lap swimmers tend to use the side away from the Clubhouse. Therefore when lap swimming is in progress, it is courteous for others to use the side of the pool closest to the clubhouse.

L. Users are to clean up after themselves. Trash shall be put in the available trash containers.

IV. TENNIS COURTS

A. Tennis playing guests must be accompanied by a playing resident member.

B. Tennis shoes must be worn; no bare feet or street shoes.

C. Appropriate tennis attire is required to play, including shirts.

D. No cut-offs, blue jeans, or bathing suits.

E. When tennis courts are fully occupied, time on court is limited to 60 minutes for singles or 90 minutes for doubles. Members waiting to play will enter name and time on sign-up board, and place racket on board.

F. The tennis courts may only be used for tennis, without specific Board approval.

G. No pets are allowed in the tennis enclosure.

V. PARKING AND VEHICLES

A. Owners shall park their personal vehicle(s) in their garage during overnight hours in accordance with the requirements in the CC & Rs. If owner vehicles cannot be accommodated in the owner’s garage, a permit to use the guest parking spaces must be requested from the Board with an explanation of the reason for such request. If the Board determines that use of the guest parking space is necessary, a permit shall be issued by the Board that shall be displayed on the dashboard of the vehicle. The permit shall include a phone number to allow notification if the permit is rescinded by the Board. In the event that guest parking becomes innadequate as a result of owner parking, such owner parking shall be terminated.

B. Overnight parking in the three designated guest parking lots shall be limited to passenger vehicles which do not exceed the dimensions of the parking spaces. Passenger vehicles as defined herein, include the Department of Motor Vehicle’s definition of ". . any motor vehicle, other than a motortruck or truck tractor, designed specifically for carrying not more than 10 persons, including the driver, and used, or maintained, for the transportation of persons." Vehicles with obvious commercial identification, trailers of any kind, and any form of vehicle which extends beyond the dimensions of the parking space shall not be parked in the guest parking lots. However, guest vehicles and owner vehicles with special permits under the provisions of (A above) irrespective of type, will be accommodated as long as they meet the size criteria (ie they fit in the space).

C. Between 2 a.m. and 6 a.m. no vehicle of any type may be parked, or left, on East Ranch Road. Guest vehicles may remain in the three designated parking areas during that period contingent on the limitations of "B" above.. A towing company has been authorized to tow vehicles left on East Ranch Road or in the alleys between the hours of 2:00 a.m. and 6:00 a.m.

D. Because of the needs of emergency vehicle access, there will be no unattended parking that will block walkways, driveways, garages, alleys, intersections, or islands. The only exception is essential construction, maintenance, and service vehicles when necessary to perform those functions. There shall be someone available to move such vehicles if access is required and blocked by the vehicle.

E. No parking stall in the three Designated Parking Areas is to be occupied,
continuously by any vehicle in excess of three days without being moved.

F. Violators of parking rules are subject to being towed and/or a fine not to exceed $100. (Reference CC& R, Article II, Section 9).

G. Vehicle Speed: Because the private streets and service alleys must also be used for pedestrian access, the CC & Rs (Article VII. Section 26) requires that vehicle speeds shall be limited to ten 10 miles per hour thereon.


VI. PET ANIMALS

A All pets will be kept on a leash or positively restrained while in the common areas of East Ranch.

B. Immediate pickup and disposal of pet waste is the responsibility of the pet owner.

C. Any pet that disturbs the peace and quiet of other residents may be cause for Board action against the owner. The Board may levy fines, up to $100 maximum; or if necessary, initiate "cease and desist" orders.


VII. FLAGS AND SIGNS.

A. U.S. Flags. The Federal Flag Code (Public Law 344, 94th Congress) is the basic guide for all handling and display of the Flag. The Code does not impose any federal penalties for misuse of the Flag. However, it may be helpful to quote a few of the many rules on handling and display for the residents who choose to display the Flag, either on specific days or continuously. The Federal Flag Code (Public Law 344, 94th Congress) states, in part:

Rule 3. "The Flag shall not be displayed on days when the weather is inclement, except when an all weather flag is displayed."

Rule 26. "On Memorial Day the Flag should be displayed at half mast until noon only, then raised to the top of the staff."
Rule 42. "When the Flag is badly torn, soiled, or faded that it is no longer a fitting emblem for display the Flag shall be destroyed in a dignified way [e.g. private burning]. A torn Flag may be mended, or if soiled may be washed or dry cleaned."

B. Other Flags. Some residents choose to display decorative and/or seasonal signs. This is permitted if in good taste as determined by the Architectural Committee, honors the preeminence ofthe U.S. Flag, and does not impede ground maintenance beyond the residence Lot lines (fenced area).

C. Signs. There are a number of residential signs that identify the company providing security and alarm services to the residence. Such signs are permitted if the emphasis is on security (not advertising); and if they do not impede ground maintenance beyond the Lot lines.

D. For Sale Signs. These signs shall only be displayed inside the most visible window for notification purposes and shall not exceed 2’ x 2’. This does not apply to the signs by Real Estate firms advertising Open Houses and related directional information. Open house signs shall be removed at the completion of the open house.


VII. OTHER RULES

A. Balls shall not be bounced against any exterior residence walls or fences.

B. Because of potential liability concerns, East Ranch Road and the alleys shall not be used specifically for recreational activities.


VIII AUTHORITY OF BOARD MEMBERS

A. The authority and responsibility of Board Members, either singularly or in body, shall specifically include the authority to expel or exclude from common facilities for a twenty-four hour period, any individual who, while in or around common facilities, conducts himself or herself, in a manner that creates an obvious or potential risk of harm to persons or property.

B. Accordingly, the term "Association" used herein shall be defined as the Board of Directors, either singularly or in body, when used in terms of action.
