Community Rules and Regulations


1. ARCHITECTURAL CONTROL:
a. The covenants do not permit any changes in landscaping, in or of any structure (residence or common), that presently exist within Bristol Cove Townhouse without approval of the Architectural Control Committee. This includes, but not limited to: decorations, walls, shrubs walkways and patios. Request for changes should be submitted to the Association Manager for forwarding to the Chairman of the Architectural Committee.

2. MAINTENANCE APPEARANCE AND UNIFORMITY: In order to maintain appearance and uniformity throughout the complex in accordance with the By-Laws and Declarations of the Association, the following rules and regulations are further clarified:

a. No articles shall be place on or in any of the Common Areas except for those articles of property which are the common property of all of the Unit Owners.

b. Live foliage, kept in good condition, may hang from balconies and porches during the summer months. Nothing else may hang from balconies or overhangs; wind chimes are not acceptable. Vegetable gardens are strictly prohibited on front patios.


c. Commercial door mats are acceptable in as much as they are solid in color and approximately 2’ X 3’ in size. No carpet scraps, PLEASE, and no indoor/outdoor carpeting. Be reminded, it is not the responsibility of the Association to remove snow from or sweep these mats, patios, porches, balconies and the passage ways between the garages. It is the responsibility of the each owner to keep them free of debris.

d. Window consideration: No reflective coatings of any kind is allowed. Within six months of your purchase date there must be proper window attire. No signs other than approved “For Rent” or “For Sale” are allowed in windows. Contact the management agent at 730-2200 to obtain approved signs.


e. Storm doors are to be aluminum or steel: Preferable white or black. Approval of the Architectural Committee is required.

f. No owner, resident or lessee shall install wiring for electrical or telephone installation or for any purpose; nor shall any television or radio antenna, machines or air conditioning units be installed on the exterior of the units or protrude through the walls or the roof of the units. This includes, but not necessarily limited to: CB, FM, AM, Shortwave, Microwave, Ham and HBO.


g. Each lot shall at all times be kept clean, sightly, and in a wholesome condition. No trash, litter, junk, boxes, container, bottles, cans, implements, machinery, or lumber shall be permitted to remain exposed upon any lot so that the same is visible from any neighboring lot or street.

h. No clothesline, dog runs, drying yards, service yards, wood piles, or storage areas shall be located on any lot as to be visible from a street and/or public view and/or the common area.


i. No garbage, refuse, rubbish, etc., shall be deposited on any street; or on any lot, unless placed in a suitable container located solely for the purpose of garbage pick-up.

j. Every owner must perform, promptly, at his own expense, all maintenance and repair work within his own townhouse which, if omitted would affect the appearance or aesthetic integrity of part or all of the townhouse project.


k. An owner shall be obligated to reimburse the Associations promptly upon receipt of its statement for any expenditures incurred by the Association in repairing any Common Area element damaged by is negligence or abuse, or by the negligence or abuse of his tenants, agents or guests.


3. PARKING:
a. No vehicles are permitted to park in designated Fire Lanes. All alleys behind units are Fire Lanes. Vehicles parked in this area are subject to immediate towing.

b. All other off street parking with the exception of the above mentioned shall be considered 48 hour parking only.


c. All vehicles are required to have current registration, and be in operable condition.

d. Storage of vehicle in above mentioned parking areas is prohibited.


e. Failure to follow the policy will result in the vehicle being towed at owner’s expense.

f. Vehicles will be towed by company whose signs are posted on the property.


g. As stated in the Declaration, “No commercial type of vehicles, campers, trailer, boats, recreational vehicles, or trucks shall be stored or parked on the common elements nor shall they be parked on any common driveways except while engaged in transport to and from the building “or in a garage”.

h. Townhouse owners are requested to park their cars in their garages in order to lessen the parking problems on South Cove Circle.



4. ANIMALS:

a. No animals, livestock, reptiles or birds shall be kept on any part of the Townhouse Project, except that domesticated dogs, cats, birds, fish may be kept in a Townhouse Unit so long as such pets are not kept for commercial purposes, do not make objectionable noises or are not kept in such number or manner as to otherwise constitute a nuisance or inconvenience to any resident of the properties, and are kept in compliance with all existing applicable local ordinances.


5. MISCELLANEOUS:

a. No noxious or offensive activity shall be permitted upon an lot or common area, nor shall anything be done or placed on any lot or common area which in or may become a nuisance or cause embarrassment disturbance, danger, or annoyance to others.

b. No activities shall be conducted on any lot or common area which are or might be unsafe or hazardous to any person or property. This includes, but is not limited to, discharging of firearms, firecrackers and open fires (except interior fireplaces and contained barbeque units).


c. No light shall be permitted on any lot which is unreasonable bright. Owners and occupants shall exercise reasonable care to avoid making or permitting to be made loud, disturbing or objectionable noises, and in using or playing or permitted to be used or played musical instruments, radios, phonographs, television set, amplifiers and any other instruments or devices in such a manner as might disturb owners, tenants or occupants of other units.

d. For you safety and welfare, and to maintain the appearance of the property, garage doors should be kept closed.


e. No odor shall be permitted on any lot which is noxious or offensive to others.
f. Unit Owners, members of their families, their guests, residents, tenants or lessees shall no use sidewalks, entrances and passageways as a play area.


g. No lot or any structure thereon, or any portion thereof may be leased or rented for a period of less than ninety (180) days and may not be used for hotel or transient purposes. All leases shall include all restrictions of the covenants and conditions of Bristol Cove Townhouse Association Inc. Failure to comply with these conditions shall be a default under the lease. All leases must be in writing an a copy delivered to the management offices of Bristol Cove Townhouse Association Inc. within (10) days of execution.


6. RECREATIONAL CENTER GUIDE:

The recreation facilities are for the use and enjoyment of all property owners. The following guide is for the health and safety of everyone.

TENNIS COURT:

a. Limited to Bristol Cove Townhouse residents only.

b. Correct tennis shoes are required. No street shoes are allowed.


c. Use extra care with metal rimmed tennis racquet as the metal chips the asphalt court

d. No children under (14) are permitted on the court without adult supervision.


e. The use of bicycles, skateboards, hardballs, etc., is prohibited.

f. No pets are permitted on the tennis court.


g. Be considerate by limiting playing time to one hour if others are waiting to play.


ALL ASSOCIATION ASSESSMENTS MUST BE PAID IN FULL PRIOR TO USE OF THE TENNIS COURT.





7. MAINTENACE FEES:

a. Your maintenance fee is due on or before the first day of each month. A late charge of $20.00 will be assessed for payments not received on or before the fifteenth of the month.

b. The Association will accept cash or certified check only to cover any check returned by the bank because of insufficient funds. Should this occur twice to the same resident, all future payments must be cash or certified check only. There is a $10.00 charge for all insufficient funds checks.



8. ENFORCEMENT OF RULES:

In order to enforce the above stated rules, the following procedures have been established; A written complaint concerning violations of the rules should be made to the Management Company. Upon receipt of this complaint, a letter will be sent to the owner concerning the violation. The owner will then have the opportunity either to correct or contest the violation. Fines are as follows; 1st notice no fine, 2nd notice $25, 3rd notice $50, 4th and subsequent notices $100. Failure to pay said fine will result in a suspension of your right to use the common area. Delinquent fines will result in a lien against your property.
