ARTICLE I
  1. The name of this organization shall be the Barcley Estates Home Owners Association.

ARTICLE II
  1. The Association shall be open only to homeowners within and residing in the boundaries of Barcley Estates as now constituted, or as enlarged by annexation or established by law.

ARTICLE III
  1. The purposes of the Association are:

    1. To provide an organization to protect the aesthetic values and the best interest of the homeowners in the area.

    2. To enforce compliance with the Barcley Estates Deed Restrictions of Record by assisting in taking proper action to abate violations of Deed Restrictions.

    3. To Amend the Deed Restrictions whenever necessary.

  2. To act as a liaison group through properly appointed committees to work with the City, County, State, and Federal Governments, and to discuss with them ideas and problems affecting the area covered by this Association.

ARTICLE IV
  1. Regular quarterly meetings shall be held at a public place during the months of February, May, August and November at a time and place to be designated by the Executive Board.

  2. Special Meetings to conduct important business of the Association may be called by the Board.

  3. The Executive Board shall meet at the call of the President.

ARTICLE V
  1. The Elective officers of the Association shall be: President, Vice President, Treasurer and Secretary, which shall constitute and serve as the Executive Board. Nominating and Ad Hoc committees shall be appointed by the President and approved by the Executive Board. Nominations, elections and installations shall be held at the February meeting. Any officer absent from three (3) consecutive Board Meetings without valid reason, shall be automatically removed from office.

  2. In the event of death, resignation, removal or inability of an officer to serve his/her term of office, the President, with the approval of the Board, shall appoint a substitute to serve the balance of said term.

ARTICLE VI
  1. The President shall preside at all meetings. He/She shall appoint all committees, with the approval of the Executive Board, and be responsible for the proper function thereof.

  2. The Vice President shall perform the duties of and have the privileges of the President, when the President is absent from any meetings or is unable to perform his/her duties.

  3. The Secretary shall perform the duties that usually pertain to his/her office. He/She shall keep the minutes of all regular, Board, or special meetings, retaining all of these in a permanent record book, shall correspond as directed by the Board, and shall issue all meeting notices.

  4. The Treasurer shall collect all dues, issuing a receipt therefore. He/She shall be custodian of all funds which shall be deposited in a bank acceptable to the Executive Board. He/She shall disburse such funds by direction of the Executive Board. He/She shall maintain an accurate and current record of all funds and a membership roster in a bound book, keeping same accessible at all times to the Association. He/She shall be prepared to give a financial statement at all regular and Board meetings, with all statements subject to audit.

ARTICLE VII
  1. Order of Business at Association:
    1. Reading of Minutes

    2. Treasurer’s Report

    3. Report of Officers and Committees

    4. Unfinished Business

    5. New Business

    6. Adjournment

ARTICLE VIII
  1. The Association members present at a regularly scheduled meeting or special meeting shall constitute a quorum for the transaction of all business.

  2. The Association shall be non-partisan. It shall not endorse any candidate for any political office. At the same time it shall not presume to exercise any restraint on any member as to his/her approval of, or work for any candidate.

ARTICLE IX
  1. The dues shall be set by the Executive Board and reviewed annually. Dues are payable the First meeting of February of each year. Members failing to pay dues shall be denied voting privileges until dues are paid.

  2. Voting privileges shall be extended to homeowners who pay their dues. There shall be one vote per home.

ARTICLE X
  1. Amendments – This Constitution may be amended or new Articles added by a majority of the members who are eligible to vote and are present at a regular or special meeting. Proposed amendments must be known to the membership thirty (30) days in advance of this meeting.

  2. Roberts Rules of Order shall be the parliamentary authority for any matters of procedure for all matters covered by this Constitution.


BARCLEY ESTATE OF THE MONTH
Our aim is to acknowledge and congratulate property care and maintenance exhibited in an outstanding manner by a family in Barcley Estates. While there may be many which are lovely and well kept, only one per month will be selected by a committee to display the impressive BARCLEY ESTATE OF THE MONTH sign and to possess the travelling trophy for that month. No home shall be eligible more than once per year to receive the award.
