A Petition to Amend Moon Mountain Vista Homeowner’s Association Covenants, Conditions and Restrictions
In order to achieve a stabilized community of owner-occupied homes, to avoid artificial inflation of prices caused by resale by speculators and to prevent scarcity caused by vacant homes awaiting resale by speculators, the conveyance made by title deeds are conditioned upon and subject to the Moon Mountain Vista Homeowner’s Association Covenants, Conditions and Restrictions, hereafter known as Exhibit “A”. The intent of this petition is to amend Exhibit “A”, which would prohibit future lease or rental of homes within Moon Mountain Vistas Unit Three.

The pertinent part of Exhibit ''A”, which is Article VIII, Section 8.1 (a) in part reads as follows:” Single Family Residential Use. … Nothing herein shall be deemed to prevent the leasing of any lot with the improvements thereon to a single family from time to time by the Owner thereof …”

This petition in effect strikes the language, “Nothing herein shall be deemed to prevent the leasing of any lot with the improvements thereon to a single family from time to time by the Owner thereof.” and inserts, “Each Owner shall use and occupy the home as the Owner's principal place of residence within 90 day of close of escrow and shall continue to use and occupy the home for the duration of ownership. The Owner of each home shall not lease or rent the home at any time for any reason.”

Most homeowners signed amendment

As of this posting, 30 homeowners have signed the petiton of ammend the CC&R. However, there are several who had expressed concerns and refused to sign the petition. In order for the amendment to take effect 42 homeowners must sign the petition. We are close but are finding more opposition as we try to collect the last few signatures.

As of this posting, we have two more homeowners who signed onto the petition. We have collected 33, so we need 9 more. We have 6 homeowner who are undecided and 12 that haven't been contacted yet.
