HOA RULES AND REGULATIONS
Revised August 2005
Due to the special circumstances of apartment living: maintaining the apartment value, insuring an attractive, uniform community and the HOA insurance policy, these rules and regulations in addition to the CC&R's and by-laws are necessary. Violations of these rules and regulations are subject to warnings and/or fines by the Homeowners Association.
Fines will be $60.00 or as noted. Failure to correct the violation within the specified time will result in fines being doubled.

It is the Leesor’s responsibility to make sure that their tenants receive a copy of the Rules and Regulations. Notice of the violation will be sent to the Lessor only. Lessor will be held liable for any violations committed by their tenants/guests.

Desert Heights Common Areas:
FOR THE SAFETY OF ALL PERSONS WHILE ON OUR COMMUNITY:

There is no riding of; bicycle(s), roller skates, scooters, skateboards, and wagons, (motorized vehicles included) on our community grounds. There will be no ball playing of any kind, I.E. i.e.. football, baseball, soccer, etc.

Residents will keep off the landscaping. i.e. grass, rock areas, and bushes. There will be a $25.00 Fee charge anyone found destroying any part of our landscaping.

Rock throwing is not allowed, legal action will be pursued.

The use of firearms, BB guns, pellet guns, knives, slingshot or archery equipment are not permitted within the common areas of Hunter's Pointe property.

No motor vehicle, trailer, camper, motorcycle, boat, etc. is to be driven or parked on common area grass, gravel or sidewalks at any time.

PERSONAL PROPERTY- No personal property of any kind will be placed or kept on the lawns. Trees and shrubbery are a vital and valuable part of the Apartment Community. Tenants understand they will be responsible for any damage, which is caused by the tenants, their guests or visitors.

TRASH:
Trash - newspapers, cans and other garbage should be placed only in the designated containers. Items left outside the dumpster are subject to an immediate $60.00 fine. Tenants will comply with all governmental regulations relating to the containers and their use.

The Dumpster lids must remain closed at all times.

Large item (furniture, appliances, etc.) pick up must be arranged by the HOA. Please call 480-329-0636 to schedule and pay for this service.

Lessees, their families, and guests shall maintain order in the buildings and grounds. Lessees are responsible for actions of their guests.
MANAGEMENT WILL HAVE THE RIGHT TO DDETERMINE WHAT CONSTITUTES DISORDER, OR INTERFERENCE WITH THE RIGHTS AND COMFORTS OF OTHER RESIDENTS. AN ADULT AT ALL TIMES WHILE ON THE ROPERTY MUST ACCOMPLANY ANY ONE UNDER THE AGE OF 14.

PETS:
All animals must be on a leash, in hand and in control at all times when in designated pet area of the community. Animal Control will be alerted and fines assessed by the HOA.

Pets are not allowed in the pool area.

Immediate removal of animal droppings is required as they occur.

No animals are to be tied or kept outside of the Dwelling Unit. Failure to abide will result in an immediate fine of $60.00.

Pets may not cause a disturbance to others due to noise or their vicious nature etc.


VEHICLES:
Auto repair, including the changing of oil, is not permitted within the common parking areas. Repairing of any motor vehicle for compensation, either financial or any kind is prohibited.

Speed limit is 12 miles an hour.

Parking:
ANY VEHICLE IN VIOLATION OF THE PARKING GUIDELINES, WILL BE SUBJECT TO TOWING AT VEHILCE OWNERS EXPENSE WITH ANY PRIOR WARNING OF A VIOLATION
Please be advised: Parking in any of the red curb and posted fire lane areas is prohibited, parking in front of any garage door area prohibited. Any vehicle in non- operational condition or with any of the following: expired license plate, no current registration tags, not covered by insurance, broken windows, flat tires or vehicles leaking any kind of fluids will be towed form the property. Owner of said vehicle will be assessed to the cost of any clean up required. All vehicles must head-in–park only. Management and the HOA reserves the right to tow away, at owner’s expense, any vehicle improperly parked or in violation of the above rules with our prior notice to placed on the vehicle.
Garage doors must close fully without anything protruding past the garage door.

Car Alarms:
Any vehicle that has an anti theft alarm or horn that goes off repeatedly and disturbs residents for more than 15 minutes will be towed at the owner’s expense. This policy shall be considered notice to the owner or operator and no furthur notice to the owner or operator shall be necessary prior to towing.


Building Exterior

The sidewalks , steps and stairways shall not be obstructed or used for any purpose other than those of ingress or egress.

Residents are not to hang, display, or expose to public view, any clothing, laundry, mops, brooms, or other items inconsistent with the d?©cor and atmosphere of the apartment community.

Please keep your patios and balconies clean.

We do not permit antennas or satellite dishes of any type to be installed on the exterior of the building.

Windows
To keep the overall appearance of the property attractive, foil, solar screens, masking tape or any foreign objects cannot be used on the windows.

Colored blinds are not allowed nor colored drapes on the outside of the apartment. Only window treatments with white linings will be allowed.

Items should not be placed on the windows.

No shades, screens, awnings or other projections will be attached to or extend beyond the outside walls, windows, or doors of the Dwelling Unit without Landlord’s written consent.

Barbeque Grills-
Gas grills are allowed on the patio or balcony as long as proof of renter’s insurance is provided to the management in writing.

Signage
No signs, advertisements, notice or other lettering will be placed anywhere in the Apartment Community or in the windows of the Dwelling Unit.



POOL RULES

Swim at your own risk, there are no life guards.
The conduct of persons in the use of the pool shall be such that it will not endanger the safety of others.
Do not prop the gate open.
All items that could be used to climb the pool fence will be removed from around the fence.
Posted pool rules are to be followed.
Glass containers and pets are not allowed in the pool areas.
Adult Residents of the premises shall not have more than 2 guests at the pool at one time unless written permission is secured from the Management.
Lessee must accompany guests to the pool.
Only proper swimwear is permitted in the pool, no street clothes are allowed.
NO ONE under the age of 16 is allowed in the pool without adult supervision.
Pool hours 6:00 a.m. to 10:00 p.m. Violators will be considered treaspassers and prosecuted.

Desert Heights Apartments are condomium style living units with individual garages. The four-plex style units are individually owned and operated. The Sun Gardens Homeonwers Associaition maintans the common areas, pool, and laundry facility.
