Nuisance barking - HOA not enforcing rules

We moved to the Harvest Glen subdivision in 2018. Within the first week, we were woken by dogs barking at 3:45-5am multiple days of the week, not to mention the 15+ minutes throughout the day of the dogs barking incessantly. We spoke with the homeowner 3 times and they said they wouldn't do anything about it. (Please note the homeowner is retired and stays home with the dogs all day). Since civil discussion wasn't working, we felt the need to escalate it, so we went through the association. Not until nearly a year after we moved in did we finally get a decision, and the decision was that they weren't in violation, despite us providing 30+ minutes of barking videos and the rules and regulations state quiet enjoyment and that "neighbors should be conscientious of their pets making noise. They shouldn't leave their dogs unattended to disturb the neighbors". The association brushed their hands of it, and the problem still continues waking us up as well as our now 2-year-old.
