What about Deed Restrictions?

Bayshore Gardens Home Owners Association Research Project
The Home owners association has the obligation to its members and the community to ?“Act as the liaison between residents and the Board of Trustees in order to improve the well being of the property owners and to do what ever is necessary in the premises and within the charter to affect a healthy, clean, safe and livable community.?” There is an inherent responsibility of the Association Board to gather input from all effected, member or not.

The Association has been active in developing the Quality Community Team (QCT), Imagine Manatee and Greenways, through the County Planning Office; Council of Communities for District 4, the County commissioners; Keep Manatee Beautiful and the list goes on and on with Neighborhood Enhancement Grants and then some, let alone the social functions they sponsor.

Since the first of this year, there has been a push by a handful of members to reinitiate Deed Restrictions. In 1987, the Deed Restrictions then enforceable had expired and the community of Bayshore Gardens fell under the auspices of the Manatee County Code Enforcement Office and existing County Code. Three meetings were scheduled to give Homeowners the chance to provide input. The first was held Saturday, May 10th, 2003 where a copy of the old Deed Restrictions and current County Code pamphlets were disseminated and discussed. The next meeting is scheduled for Saturday June 14th, 2003 to list the recommended restrictions and alternatives. The last meeting will be to finalize a report to the Board of Trustees, with a recommendation to have the Deed Restrictions on the Ballot in December or other appropriate recommendations as the meetings dictate.

I am of the opinion that the County Code is sufficient. What we need to do is coordinate blocks of area and offer assistance to those areas in the form of help and guidance. Understanding that many in our community are on limited incomes, incapable of the physical demands, lost their spouse, or simply do not know how, could appreciate a helping hand. Not a core of vigilantes nor that we will start a lawn mowing brigade, rather help find an amicable solution instead. Between the County Code Enforcement, neighborly assistance, animal control, a spirit of cooperation and a positive attitude toward solutions, we can solve these problems without undue regulations. I believe in the words of Mr. Fred (?“Mr. Rogers Neighborhood?” on PBS) Rogers who said, ?“We live in a world in which we need to share responsibility. It's easy to say ''It's not my child, not my community, not my world, not my problem.'' Then there are those who see the need and respond. I consider those people my heroes.?”
