AMENDED
DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS
LAKE PATAGONIA RANCH UNIT VI B
PARCELS 15, 18 through 37, 45 through 58

FIRST AMERICAN TITLE INSURANCE COMPANY, a California corporation, as Trustee, Trust 7863, being the owner of Parcels 15, 18 through 37, 45 through 58, Lake Patagonia Ranch Unit VI, according to the survey map of Record in the Office of the Santa Cruz Recorder, Book 4 of' Maps, Page 42 (the "Property") acting on behalf of its Beneficiary, Richard D. Schust and Christy L. Schust, and desiring to establish the nature and enjoyment of said Property hereby subjects such Property to and incorporates herein by reference the Amended Declaration of Covenants, Conditions and Restrictions of Lake Patagonia Ranch, as recorded in the Office of the Santa Cruz County Recorder on the 17th day of February, 1984, in Docket 370. Page 410 to 419 ("Declaration"), subject to the following modifications: 

Architectural Guidelines are as follows: 

a. The minimum size of the interior floor space of dwelling units, exclusive of carports, garages, breezeways, patios, terraces, and porches, shall be 1500 square feet. 

b. The maximum height of any building shall not exceed 25 feet above the adjacent average finish grade to the highest roof ridge, peak or parapet. Chimneys and other similar architectural features are excluded. 

c. The exterior wall and roof materials, flashing, gutters, vents, metal chimneys, etc. shall be finished or coated so as to minimize the reflections on adjacent or neighboring properties. Earth tones of indigenous hues will be encouraged. 

d. No solid wall or fence of any type over 6 feet in height shall be erected. 

e. Architectural styles deemed by the Architectural Review Committee as incompatible or inappropriate to the area shall not be erected. 

f. All structures shall he constructed in compliance with the latest adopted edition of' the Santa Cruz Building Code and Regulations. 

The following sentence shall be added to paragraph 8 of Article I (Use Restrictions): "No horses, cattle or other livestock shall be allowed to run free, and shall be contained within a parcel in a fenced in area. The owner of' the horses, cattle or other livestock shall be fully responsible for any damages or costs involved, including the value of services rendered by the County of Santa Cruz, due to a violation of this paragraph. This restriction shall be enforceable by other owners, as provided for in Article X of' the Declaration, aid by the County of Santa Cruz." 

There shall be a new paragraph 14 under Article I which recites as follows: 

There is a perimeter fence as shown on the map of' the Property which adjoins the rear properly linen of parcels 45, 48, 49, 52, 53, 54, 55, 56, 57 and 58. It is the responsibility of each parcel owner to properly maintain, to state standards (including repairs and replacements as needed) said fence where the fence adjoins each lot. In the event of a failure to do so by the adjacent owner, the Association shall have the obligation to do so at the expense of the owner and shall have the right, through its officers and agents, to enter upon the owner's lot for the purpose of affecting said maintenance. Failure of the owner to reimburse the Association for its costs so incurred, within ten (10) days of advise thereof by the Association, shall entitle the Association to pursue all available assessment enforcement remedies as provided for under the Declaration. 

Except as above modified, said Declaration shall be fully applicable to the above described property. 

This Amended Declaration of Covenants, Conditions and Restrictions for Lake Patagonia Unit VI, Parcels 15, (8 through 37, 45 through 58 supersedes and replaces the previous Declaration thereof dated 8/21/92 and recorded in Docket 591, page 886-7, records of the Santa Cruz County Recorder.
