Drexel Terrace Protective Covenants

BUILDING RESTRICTIONS OR PROTECTIVE COVENANTS APPLICABLE TO DREXEL TERRACE, AS SHOWN ON THE PLAT MADE BY PIEDMONT ENGINEERING SERVICE, AND RECORDED IN THE RMC OFFICE FOR GREENVILLE COUNTY, S.C., IN PLAT BOOK 671, AT PAGE 355.



The following building restrictions or protective covenants are hereby imposed by the undersigned, who is the owner of all lots in Drexel Terrace, as shown by plat thereof recorded in the RMC Office for Greenville County, S.C., in Plat Book QQ, at page 177. These protective covenants are to run with the land and shall be binding on all persons claiming under them. Said covenants shall be automatically extended for successive periods of ten years unless by a majority of the then owners it is agreed to change said covenants in whole or in part.

If the parties hereto, or any of them or their heirs or assigns, shall violate or attempt to violate any of the covenants herein contained, the Board may upon ten (10) days written notice to the owner of the offending Residential Lot, after which time it shall be lawful for any other person, or persons owning any real property situated in said development or subdivision to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenants, and either to prevent him or them from so doing or to recover damages or other dues for such violation. Invalidation of any one of the covenants by Judgment or Court Order shall in no way affect any of the other provisions, which shall remain in full force and effect.

1. No lot shall be used except for residential purposes. No business or commercial building may be erected on any residential lot and no business may be conducted on any part thereof. No building shall be erected, altered, placed or permitted to remain on any lot other than one detached single—family dwelling not to exceed two and one—half stories in height, and a private garage for not more than two cars. This property shall be used only for single—family residences; however, any lots may be used for the construction of a building for educational or religious purposes when authorized by the committee hereinafter referred to.

2. No building shall be erected, placed or altered on any building plot in this subdivision until the building plans (including front, side and rear elevations) , specifications (including construction materials) , and plot plan showing the location of such building has been approved in writing as to conformity and harmony of external design with existing structures in the subdivision, and as to location of the building with respect to topography and finished grade elevation by W.B. Simmons and Eston L. Rodgers or either of them, or a committee to be appointed by them, of which Eston L. Rodgers shall be the chairman, or by a representative designated by a majority of the members of such committee. The undersigned property owner reserves the right to change or increase the membership of said committee at any time. In the event of death or resignation of any member of said committee, the remaining member or members shall have full authority to approve or disapprove such design and location or to designate a representative with such authority. In the event of said committee, or its designated representatives, fails to approve or disapprove of such design and location within thirty (30) days after said plans and specifications have been submitted to it, or in any event, if no suit to enjoin the erection of such buildings or the making of such alterations has been commenced prior to the completion thereof, such approval will not be required, and this covenant will be deemed to have been fully complied with. Neither the members of such committee, nor its designated representative, shall be entitled to any compensation for services performed pursuant to this covenant.

2. The powers and duties of such committee, or its designated representative shall cease on and after April 1, 1986. Thereafter the approval described in this covenant shall not be required unless, prior to said date and effective thereon, a written instrument shall be executed by the then record owners of a majority of the lots in this subdivision, and duly recorded, appointing a representative or representatives who shall there after exercise the same powers previously exercised by said committee.

3. No building shall be located nearer to the front lot lines or nearer to the side Street lines than the building lines shown on the recorded plat. In any event, no building shall be located on any residential building plot nearer than 30 feet to the front lot line or nearer than 10 feet to a side lot line. No building located 75 feet or more from the front lot line shall be located nearer than 5 feet to any side lot line or nearer than 5 feet to any rear lot line.

4. No lot shall be recut so as to face in any direction other than as shown on the recorded plat; nor shall any lot be recut so as to contain an area less than it now has, as shown on said recorded plat, unless such recutting is done for the purpose of enlarging the size of the adjacent lots.

5. No dwelling shall be permitted on any lot with the ground floor area of the main structure, exclusive of one—story open porches, breezeways, and garages or carports, less than 1500 square feet for a one—story dwelling, nor less than 1250 square feet for a dwelling of more than one story. For the purpose of computing said minimum square footage of the main structure, enclosed porches may be included at one—half their measured square footage. No dwellings shall be constructed of concrete blocks.


Covenant & Effect on Property Values (What is required of you)

6. In order to provide congenial occupancy of the property and for the protection of the value of the residential dwelling units, the use of property in Drexel Terrace shall be in accordance the provisions of this declaration.

A) Common Areas. The common areas shall be used only for the purposes for which they were intended as in furnishing services for the enjoyment of the owners. There shall be no obstruction or alteration of, nor shall anything be stored, altered or constructed in, or removed from, the Common Areas without prior written approval from the Board.

Insurance. No use shall be made of the Common Area that will increase the rate of insurance upon the Property without prior written consent of the Board.

Nuisances. No obnoxious, immoral, improper, offensive or unlawful activity shall be allowed upon the Common Area, nor any use or practice which is the source of annoyance or nuisance to owners or guests or which interferes with peaceful possession and proper use of the Common areas by Owners.

B) Residential Lots.

No obnoxious, illegal, offensive trade or activity shall be conducted upon any lot, nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood. No trash, garbage, rubbish, debris, waste material, or other refuse shall be deposited or allowed to accumulate on any part of the property.

No mobile home,recreational vehicle, trailer, tent, shed, shack, garage, barn, or any other out building upon, or erected in the subdivision, shall at any time be used as a residence, temporarily or permanently. Nor shall any structure of temporary character be erected or permitted to remain on any residential lot.

Exterior Maintenance. Each owner shall be responsible for the maintenance of the lawn, landscaping, and exterior of all buildings on the Residential Lot owned by such owner all of which shall be maintained in a neat and orderly manner with the lawns cut, landscaping trimmed and the exterior painted and in good repair.

Pets. No animals or birds shall be kept on the Property for any commercial or breeding purpose. Not more than three (3) domestic animals may be kept on a residential lot for the pleasure of the occupants of the Residential Dwelling built on such lot without the prior written approval of the board. If, in the opinion of the Board, any animal becomes dangerous or an annoyance or destructive of wildlife, the Board shall have the right to require that such offending animal be removed from the property. Birds and rabbits shall be caged at all times.

Parking. No vehicle shall be parked on any Residential Lot or street of the Property unless such vehicle is operable on the highways of the state of South Carolina and has a current license tag. No repair work shall be preformed on any vehicle except minor repairs which are completed in one day. No boat,mobile home,recreation vehicle,truck or other commercial vehicle shall be long term parked on a Residential Lot except in areas completely screened in view from the streets and all other residential lots.


Utilities & Right of Way

8. The right is reserved to lay or place, or authorize the laying and placing, of sewer, gas and water pipes, telephone, telegraph and electric light poles on any of the streets shown on said recorded plat without compensation or consent of any lot owner, and an easement for the installation and maintenance of utilities and drainage facilities is reserved as shown on the recorded plat and on the rear and side 5 feet of each lot.

9. All sewerage disposal shall be by septic tank meeting the approval of the State Board of Health until such time as municipal sewerage disposal becomes available.

10. Any connection with the water line on said streets shall be at purchaser’s expense and the use of such water shall be confined to the respective lot.

11. All tanks, barrels, or containers for fuel oil shall be placed below the ground or concealed.

12. The Committee provided for in Paragraph 2 above shall have the right and power to cut or authorize the cutting and laying out of one or more streets or roads through any unimproved lots still owned by Drexel, Inc., and the further right and power to recut or authorize the recutting of any lot or lots so as to face the same on any new cut street or road.
