May 2009 Minutes

The Woodlawn Park City Council met on May 18, 2009, at Woodlawn Park City Hall. Present were Mayor Tim Robertson, Attorney Matt Carey, Chief Jim Carter, Council Members, Scott Horn, Sherry Hyde, George Langford, Christian Seidt, Greg Claypool, and Doug Watson, Treasurer Charlie Veeneman and City Clerk Chana Elswick.

The meeting began at 7:30 pm.

Mayor Tim Robertson asked if any guests would like to approach the Council. Mrs. Geirheiser stated she was concerned about the Beargrass creek ditch. She said the plans do not look like it will be deepened, and she is concerned about road runoff. George stated he called MSD about Kinloch and Westport Terrace. These will have issues until the road is widened. Tim stated the ditch will be dredged, down to the rock bottom. Mrs. Geirheiser asked if concrete was going to be used because there are endangered species in the Creek. Greg talked about flooding and drainage issues. Tim stated there will be meetings with Hall Construction and the State with the City Hall Committee.

The council reviewed the minutes for the April 20, 2009 Council Meeting. Sherry made a motion to accept the minutes for the meeting. Greg seconded the motion. All voted aye and the minutes were accepted.

Charlie Veeneman gave the Treasurer’s report. He stated we are 8 months into the year. He stated the revenue was already at the budgeted amount with 2 months left in the year. He stated the road fund was nearly at the budgeted amount. Tim stated may have to move some money from the reserve to the road fund for Stivers paving. Charlie stated $20,559.000 was paid out for FEMA expenses. He stated the insurance tax may hit $40,000.00 for the year. HB414 is finished. Property taxes still has $1,600.00 for the 2008 year. He state that trash collection was not billed correctly for 5 months, but will come in under budget. Greg made a motion to accept the Treasurer’s report. Doug seconded the motion. All voted aye and the report was accepted.
Charlie stated the oldest property tax had been collected for 2006, 2007 and 2008 years. There are still 4 outstanding. The one for 2007 and 2008 has a lien filed. Greg asked if any were for the Riney house. Charlie stated Riney owes for the current year only. Chief Carter stated he had seen people working on the house. Charlie stated that Fernandez still owes $500.00 in rental license fees and there are 4 others that owe for the current year. There is 1 business license fee still due, for Mr. Perkins. Charlie stated Truitt Ford has done everything that was needed to be reimbursed for the January ice storm. He has called the official contact in Frankfort, but has not been called back. He doe not know when we will receive the money.
Tim handed out a budget worksheet to the Council for review. Tim reviewed the worksheet with the Council. Tim stated he is asking for an additional 5% discount for property taxes paid early. Greg asked about the police car. Tim state d he had removed it from the budget but it will be re-added when a new car is needed. There was a discussion about compensating rate and property tax computation. Tim, Greg and Charlie discussed how the compensating rate was determined and the process to change the rate. Matt explained the legal procedures for changing the rate.
Chana gave the first readings if the following ordinances:
Ordinance No. 1 Series 2009-2010, An ordinance estimating revenues resources and appropriating funds for operation of City Government and adopting a budget for the period of July 1, 2009 through June 30, 2010.
Ordinance No. 2 Series 2009-2010, An ordinance adopting the Jefferson County, Kentucky ad valorem tax assessment for the City of Woodlawn Park, Kentucky and the levying of an ad valorem tax thereon for the general operating purpose of the City.

Chana Elswick gave the Clerk’s report. She stated there were 970 hits to the homepage and 2676 hits to the discussion area of the website. No action on census. Everything is done through Metro Louisville.

Chief Jim Carter gave the police report for March. There was 1 citation, 6 warnings, 107 miscellaneous runs, 1 report of a problem , and expense of $75.01. He gave the report for April. There were 9 warnings, 96

miscellaneous runs, 1 report of a burglary, 1 backup and expenses of $51.00. He stated Bob Heaton was doing fine. His training will be caught up by August 1st. Traffic went well for the yard sale. There will a block watch meeting in June.

Council Focus
Fences and Building Permits Doug Watson stated he had 1 request for a fence permit at 6934 Ambridge Circle. The plans were not inline with the ordinance and he will meet with the resident. He had a follow-up from an August ’08 request for an addition at 4315 Kinloch.
Emergency Preparedness George Langford stated there was a drainage issue behind Wingate and Westport Terrace. He met with Alan Winchell of MSD on 04/21/09. He stated they took pictures of an exposed pipe. George sent an email to Mike Marlin and was referred to Troy Smith, a drainage expert. He might be able to help with flooding in the future. He also sent an email about trash behind Kroger and he asked for updated maps. He called a CSX rep about train whistles. He stated another fence has fallen in the drainage ditch along the tracks. Scott stated they are blowing the horn because of work on the overpass. George stated that by law, CSX has to blow the horn when they see a crew working along the track.
Communication Sherry Hyde stated she had nothing to report, She has given Christian all of the address updates.
Public Relations Tim stated there was nothing new to report. The yard sale went well.
Streets and Signs Scott Horn stated the City Hall Improvement Committee meeting had been postponed until next month, to meet with Hall Construction, He is compiling a list of City street signs. There has been no action on signature entrance signs. He has heard there will be a light at Walser.
Grounds Greg Claypool stated he had taken pictures of the drainage blockage on Green Meadow Circle during the last rain storm. He stated he would like the City to consider an ordinance to enforce cleaning of drainage pipes and ditches by residents. Tim stated they could append the current ordinance. Matt stated each ordinance must stand in its own merit and to make sure it would fall under the Code Enforcement Board. Tim stated he will talk with Bill Ritz and Chief Carter about the issue.
Welcome Christian Seidt stated he had welcomed residents at 6882 Green Meadow Circle and 4307 Westport Terrace. He stated there are 2 houses for rent and 6 houses for sale in the City.

New Business
City Hall Use Agreement: Matt had reviewed Greg’s initial draft. Greg gave Council members a copy of the usage agreement. He reviewed the agreement and the guidelines for use of City Hall. He stated a Mom's Club had asked to use City Hall on a monthly basis. Tim asked about coordination of usage through Council Members. Greg stated it would mostly be used by residents and long term use requires City Council approval. Mr. Bates asked if there was a cap on the number of people in the facility and about street parking, Greg stated street parking would be allowed if the parking lot was full. He stated he would add that to the agreement. Matt stated the number of people would be set by the fire code. Tim stated there would need to be a maximum occupancy sign. Christian stated to ask the St, Matthews Fire Marshall to inspect City Hall. Chief Carter stated he would find out who to contact for the maximum occupancy level. Tim stated 2 people could meet, under Christian’s supervision on 05/19/09. Greg stated he will make changes to the agreement and bring to the next meeting.

Old Business
Westport Road Church of Christ: Tim stated he had received a letter stating the Church was going to remove the houses on Ambridge Circle.

Doug made a motion to adjourn the meeting. Sherry seconded the motion. All voted aye and the meeting was adjourned at 8:55pm.
