Chevington Woods Trustee Meeting Minutes 10/16/2006 . CHEVINGTON WOODS CIVIC ASSOCIATION MINUTES OF TRUSTEES MEETING October 16, 2006 Meeting site: Violet Twp Offices, 12970 Rustic Drive, Pickerington, OH 43147 President Comanita called the meeting to order at 7:04 p.m. The President ascertained the presence of a quorum with nine (9) trustees in attendance: Carol Comanita, President Don Roeder, VP Jim Murphy, Treasurer Will Snell, Secretary Julie Squier, Trustee Greg Fown, Trustee Lora Stevenson, Trustee Teresa Hartley, Trustee Lisa Ross, Trustee Residents in attendance: Mary Ann Murphy Tom & Linda Besser Ted & Gina Stacy Elizabeth Hamilton Karen Edwards Gene Bednarski Mike Chizmar Ron & Harlene Eggleston Barbara Deihl Larry Van Orman Melissa Lipchak Glenn & Brenda Davis Dick & Lisa Moore Alex Manukian Jim Vohwinkel Oron Schuss Mark Anctil Reading of the minutes: The Chair noted the minutes of the September 18, 2006 regular meeting had been previously distributed via email to the trustees and advised, that if there were no objections, the minutes could be approved as distributed. Thereafter, Trustee Squier moved the minutes be approved as previously distributed. The motion was duly seconded and passed without dissent. Correspondence and Resident Participation: Correspondence: None Resident Participation: Resident Gina Stacy noted that Trustee Greg Fown was omitted from the Trustees listed in the last newsletter. Secretary Snell apologized for the error and noted that it would be corrected in future publications. Resident Gina Stacy complained about the decision of the President not to appoint Richard Biggs as Trustee to fill the vacant position in CWCA Area 9. President Comanita explained the process, including her poll of the Trustees, in regard to the appointment and noted even if she had appointed Mr. Biggs the Trustees would not have approved the appointment as required by the bylaws. Resident Gina Stacy contended that there must be an active trustee from each Area of the CWCA for it to properly function. President Comanita pointed out to Mrs. Stacy that the CWCA had functioned for years with less than a full complement of Trustees and this argument was somewhat of a surprise since it had never been raised before to her knowledge. Resident Gene Bednarski inquired who authorized the spending of CWCA dues for litigation. Secretary Snell replied that the minutes of the Trustees authorizing all expenditures are on the web site or if one does not have web access the Secretary will mail any resident a copy of the Minutes upon request. Resident Karen Edwards addressed the meeting and stated that Chevington Woods was a joke among area realtors. Mrs. Edwards referred to set back violations, sheds and etc. which provoked a long discussion on past deed restriction violations. President Comanita responded that the current Trustees were simply attempting to apply the current deed restrictions as advised by counsel as appropriate under the existing laws in the State of Ohio. Resident Ted Stacy rose to announce that he was giving his five minutes of resident participation to his wife Gina. President Comanita did not object. Resident Gina Stacy rose to review the June 1991 cancellation of the Articles of Incorporation, the authority of the Trustees pursuant to the Bylaws of the Association among other things. She threatened the current trustees that if they did not resign by November 1, 2006 that she would file a lawsuit against each of them personally. Resident Estalene Newell rose to advise that she had been cited for a yard light violation. She stated the light was now working OK. She noted a camper was brought home because it was broken into. She also complained that children were running through her yard looking for deed restriction violations. Resident Elizabeth Hamilton rose to complain that she had fixed the yard light at her home before she received the citation from the CWCA. President Comanita apologized for the citation and explained that the surveys of yard lights had been conducted over a period of days and it was only when it had been out for some time that a citation had been issued. She thanked Mrs. Hamilton for correcting the deed restriction violation. Resident Kelly Schafer rose to complain the yard light rule was not being followed. She stated her family might move because of neighbor fighting neighbor and deed restrictions. At this point in the meeting residents Oron Schuss and Mark Anctil led other residents in a verbal barrage of insults toward the officers at the dais. Oron Schuss and Mark Anctil shouted, “Nazis, Gestapo, Hitler’s daughter” and other defamatory comments at the President and officers as they rushed the dais. Resident Anctil demanded that Officer Ted Stacy of the Columbus Police Department, who was in uniform and wearing a weapon, arrest resident Mike Chizmar, who did nothing provocative, but happen to be in the path of Mr. Anctil as he was charging about the room. Meanwhile, during the verbal melee, VP Don Roeder moved the meeting be adjourned and the motion was duly seconded. The Chair called for a vote and the “ayes” were noted in favor. No votes opposed to the motion were heard when called for.
