This year¡¦s annual meeting for all homeowners has been moved from January 8th at 7:00pm to January 15th @ 10:00am. The story behind this change is rather interesting so grab some hot chocolate and get cozy!

The Bylaws of the Council of co-owners of Pinnacle Gardens, which we¡¦ll refer to as ¡¥Bylaws,¡¦ which govern our association were originally adopted on November 8, 2000 by our developer, Five Star. Throughout the past seven years several Boards have amended these Bylaws to keep the document current and best serve the community. However after careful reading, it was noted that any amendments made to the Bylaws require a majority vote of all unit owners. In other words, 53 unit owners at a minimum, must approve any changes. It is unclear whether or not these steps took place in the past.

So this is where the story gets juicy! The board has decided that it¡¦s in the best interest of the association that the original bylaws be abiding (2000 version) and a proper amendment take place. With that being said, reverting back to the original bylaws poses some issues since again, these were updated to best serve the community years ago. For instance, in Article II-1 of the Bylaws, it notes that the Annual Meeting must be held at 10:00AM EST, on the 15th day of January each year. Now we realize this is a very inconvenient time for those who work during the day! So let¡¦s change it. At the annual meeting everyone will have their chance to cast their vote to amend the bylaws. There are several revisions, in addition to the meeting time, that the Board has recommended. A copy of the revisions is enclosed within this mailing. Please take a few moments to review these changes so that you will be familiar with the proposal. Following the approval of the Bylaw revisions, elections will take place for the 2008 Board of Directors.

If you are unable to attend this annual meeting, it is important you fill out the blank proxy enclosed appointing another to vote on your behalf, either our secretary, Nancy Chaplin, or another whom will attend the meeting. The proxy must be delivered or mailed to our Secretary, Nancy Chaplin @ 3420 Pinnacle Gardens Drive by January 14th, so that it may be filed accordingly. One vote per unit is allowed. Obviously, your vote is extremely important. A quorum, either in person or by proxy, must be present to conduct this year¡¦s business!!
