Kroger Highlands 2nd Floor Meeting Room

President Nancy Carrington called the meeting to order at 7:00 pm. Thanks went out to all of the volunteers for helping at the fall festival.
Nancy welcomed everyone. BSA Troop 42 from St. Raphael’s attended the meeting to learn about community government. Introductions were made around the table.
Agendas & Minutes were passed out.

Minutes--Secretary Mary Lang presented the minutes of the October 8, 2008 meeting. Ann Coates made a motion to approve. Catherine Spalding seconded. Minutes were approved

Financial Report—Treasurer Joan Combs Durso presented the financial report. The current balance is $1,550.66. A $100 check for the Arbor Day trees is still outstanding. $1450.66 is currently available. There is also a check from Highland Community Ministries of $315.00 for their share of the newsletter that has not been deposited yet.

Police Report—Officer Marc Hall gave the police report.
Vehicles being broken into are mainly unlocked vehicles.
An elderly lady had money stolen from purse.
Several fights occurred at Atherton and resulted in arrests for terroristic threatening.
One burglary and a shoplifter in Kroger?
A suspect from street robberies was apprehended and faces 15 charges so far.
In all, the crimes are down. Bike and foot patrols may be having an impact.

501(c) 3 or 4 Status Discussion—Lisa Kilkelly, Legal Aid Council, was available to facilitate the discussion.
There is no tax exempt status in the current BNA incorporation documents.
501(c) 4—contributions not be tax deductible; may lobby; for social welfare organizations.
501(c) 3—may except tax deductible contributions but has limited lobbying abilities; for charitable & educational organizations.
There is a filling fee regardless of which status is approved.

Discussion followed with explanations from Lisa Kilkelly.
BNA cannot currently receive funds because it is not a 501 (c) 3. BNA is currently registered as a Kentucky Non-Profit.
Purposes must be clearly written for events and activities to be sure they are charitable and educational. Focus on the community improvement. Public disclosure of books and reports are required with 501 (c) 3.

Discussion included the ability to seek and accept grants and donations. It was felt there was little need for BNA to lobby. Bill Braunstein made the motion to apply for the 501 (c) 3. Second by Paul Coates. Motion passed with 4 abstaining.

Council persons Report—Tom Owen
There is a new contract with Zoom group to up-keep the landscape at the loop.
Tom will meet with Police Major Smith to discuss district issues.
$4300 is slated for extra holiday patrols.
Storm debris pick-up is slow and frustrating for everyone.
FEMA reimbursement will not be used for sidewalk repairs or street repairs.
The Mayor’s Neighborhood Summit is Saturday, November 15th.
Bardstown Road overlay design is almost finished.

Presentation by Mark Bailey, Bailey and Associates
Discussion of the Belknap School Property
Mark Bailey is the architect for the Belknap Condos
Discussion on the status of the condos.
Garages for the development--no decision has been made at the present time.
10 out of 22 units of the newer building are currently sold. 17 units are proposed for the old building.
Options were discussed.
Historic tax credits will be used for the old building.
No deadline at the current time.

Old Business
BNA to make a commitment to the Fall Festival for 2009. Motion made by Clyde Lang, Second by Fred Maurer. Motion carried.

New Business
No new business.
