Everglades Club General House Rules

EACH OCCUPANT, OWNER, RENTER OR GUEST IS RESPONSIBLE FOR THE RULES WITH A COPY PROVIDED EACH UNIT.


1. USE RESTRICTIONS
Units (Section 13.1) Each unit shall be occupied at any time by only one family as a residence
Occupancy in Absence of Owner (13.2) If the owner and his family are absent and the unit is not leased the owner may permit his unit be occupied by his guests under these conditions: (A) Any one person (parent, child, spouse) may occupy the unit for up to 30 days. The total occupancy for all guests combined shall be limited to 4 in a calendar year with a maximum aggregate total of 60 days. (B) House guests not included in 13.2 are permitted for only 1 family occupancy in the owner’s absence including up to 4 people and such guests may stay only 1 week and no more than 2 times a calendar year. Occupancy When Owner is Present (13.4) There is no restriction on the number of guests, whether related or unrelated to the owner, who may occupy the unit together with the unit owner.

2. No unit can be sold, rented or leased without the approval of the Board of Directors with notification given to the Board when the owner plans to sell, rent, or lease. An owner acquiring the title to a unit may not lease or rent the unit for 1 year after acquiring such title, unless an exception is granted by the Board as provided in Section 14.3 of the Declaration. Rentals shall be for a minimum of 2 month and limited to 2 times in a 12 month period (Section 14.2 of the Declaration).

3. Guests of owners are required to sign the register sheet in the laundry room providing their names, unit number, arrival and departure dates.

4. There is a $150 fee to be paid by the owner for all sales or rental approvals with a check payable to Everglades Club and given to Moore Property Management. The President is to be notified by the owner of any prospective sales or rentals.

5. Notices of Everglades and VGOA meetings and other agendas will be posted on the bulletin board in the laundry room and/or the mailboxes.

6. No owner may own more than 1 unit at a time. (Section 15.3C of the Declaration)

7. Only “Service” and “Emotional Support” animals” supported by a doctor’s statement that addresses the person’s physical and/or emotional state will be approved by the Board. The request must include proof of compliance with state and local requirements for licensing and vaccinating. Only animals with prior board approval are allowed on the property or in the building. All animals must be on a leash at all times when outside of the owners premises.

8. The exterior of the building is community property. No one is to paint, alter, adjust or hang objects affecting the exterior appearance of the building without the approval of the Board. There shall be no removal or addition of plants potted or in ground in the landscaped areas including vegetables or herbs without Board approval. The addition or replacement of an existing patio must be approved by the Board and comply with the standards outlined by the Board. Failure to comply with those standards will result in the removal of the patio and return of the landscape to its original state at the owner’s expense.

9. Screened porches, lanais, and outside furniture must be kept free from laundry, clothing, towels, rugs or bathing suits. Nothing should be placed, per fire code, on the 2nd level walkways with the exception of doormats a quarter of an inch or less in thickness. Artificial or dead plants are not permitted. White furniture, pots and accessories are suggested although not mandatory. Permanent decorations may be hung on 1 doorway only with the hanging of seasonal decorations limited to 1 door also and may be hung 2 weeks before the holiday and removed 2 weeks after.

10. Pool rules are posted on a wall by the pool. Children under 14 must have a parent or guardian present and are limited to the hours posted. There is no lifeguard on duty.

11. Be respectful of your neighbors. Keep your electrical sound devices, radios, TV’s to a minimum. Keep courtyard and condo noise to a minimum after 9pm.

12. Owners are expected to carry homeowners insurance or recognize that they bear financial responsibility for any damage to their property or liability to others.

13. Maintenance fees are due to Moore Property Management by the 10th of each month (January 10, April 10, July 10, October 10), otherwise late fees will be charged.

14. Owners may install screen doors and windows at their expense after receiving approval from the Board.

15. Laundry Room. The laundry room can be used from 7am to 9pm. A list of rules is posted in the laundry. Do not use more than 2 washers or dryers at a time. If using 2 washers, wait 2 minutes before starting the second machine to prevent flooding. Clean the lint traps after use. Do not leave clothes hanging, and remove articles from the washers and dryers.

16. Bikes. Use bike stands and a lock. Do not park bikes anywhere other than the bike stands for more than half an hour. Remove bikes from the stands and store inside your shed or unit when leaving for the season or during hurricane warnings.

17. Smoking. Smoking is prohibited in the common areas of the Everglades Club including the courtyard area, the steps and walkways.

18. Trash. All trash must be kept in the unit until disposed of in the outside garbage disposal area. Place regular garbage in plastic bags and discard in the dumpster. Recyclables should be deposited in the blue containers. (Eg. paper, bottles, cardboard). Do not put plastic grocery bags in the recycle containers. Break down all cardboard boxes. For disposal of furniture, appliances, etc., the owner is responsible for calling the City Solid Waste Dept. (239-213-4700) and paying the fee which will initially be billed to the Everglades Club. Contractors are required to remove all construction materials. Such materials must not be placed in the dumpster.

19. Toilet Paper. Use biodegradable, one-ply toilet paper. Do not put anything else down the toilet including wipes. These materials can cause damage to the Everglades’ aging pipes.

20. Garbage disposals. Use disposals sparingly running water at least 5 to 10 seconds after turning the disposal off.

21. Complaints. Rule infractions or suggestions should be submitted in writing to a Board Member.

22. Grills. The use of grills is prohibited on any place on the premises.

23. Smoke Detectors. Every unit is hard-wired for a smoke detector. The Board changes the batteries annually. Do not remove the battery from any unit. It is recommended that a battery operated detector be put in every bedroom.

24. Leaving. Turn off the incoming water valve and unplug the hot water heater when you are gone for more than 2 days. Take in all furniture: bicycles, mats, furniture or other articles from the outside when leaving for the season. A unit inspection check is required at least once a month when the unit is not occupied. Owners will furnish the name and telephone number of the person responsible for checking their unit to the condo President.

25. Cars. Cars can be washed at the ends of the building.

26. Village Green common recreation areas: Pool, Club House, Clark Center with a library, two
computers (wireless available in and near the Clark Center), meeting room, shower rooms, rest rooms, bocce ball, shuffleboard, horseshoes and additional activities are available. (See calendar in the Clark Center).

27. Parking. Park in your assigned spot. Have all guests or workers park in your spot. Your guests may park in VGOA lot also.

28. All unit owners must furnish the President with a working key to their unit. For emergency keys to the units see the President or one of the officers.

29. Entry. All units are subject to entry and an inspection by officers or designee for structural damage, drainage, water leakage, insect problems, and replacement of smoke detector batteries. Moore Property Management will notify you of any scheduled maintenance or repair workers needing access to a unit.
